This is one of my main concerns. The way evidence is gathered for a civil trial has to remain constitutional, the way it is gathered in situations of war are not constitional (no warrants). Beyond this there is the matter of a LOT of sensetive material that can hamper further hunting (information gathering technieques, ect.).

I have to fall somewhere in the middle on this because while I don't agree with a super secret trial where no one knows the outcome I am TOTALY against a media trial. But as someone else kind of said, what makes us think this dique is actually going to make it out of Afganistan alive to be put on trial?
