Save Internet Radio The Story TOP STORY (IN FULL) Librarian of Congress Rejects Proposed Rates on Web Radio A WALL STREET JOURNAL ONLINE NEWS ROUNDUP WASHINGTON -- The Librarian of Congress has rejected proposed royalty rates that would have charged Internet music broadcasters for each song they deliver online, the U.S. Copyright Office said Tuesday. Librarian James H. Billington, who oversees the Copyright Office, offered no explanation for rejecting the rates, but said he would issue a final decision by June 20 that lays out the royalty fees to be imposed on Internet broadcasts. The proposed rates stem from a 1998 law that gave Webcasters the right to use music, but required that they pay a royalty fee, set by arbitrators, to be split between labels and performers. After years of industry discussions and complicated arbitration proceedings, arbitrators in February proposed that Internet-only Webcasters pay 0.14 cent per song per listener. Radio companies that put their broadcasts on the Web would pay half that, while noncommercial Webcasters, including public radio stations, would pay special, lower royalty rates. The recording industry had wanted higher rates, while companies that deliver music and video online had sought lower ones. The proposed rates would have cost larger Webcasters hundreds of thousands of dollars annually. In meetings with congressional staffers, online-radio executives said the proposed rate could kill their firms. A letter to the Librarian of Congress signed by 20 members of Congress expressed concern that the proposed rates might be too high.
