But if the perp was running AWAY, there was no justification in shooting him. I would still go with a manslaughter charge, as I see no intent to kill, just to stop a robbery in progress and make a citizens arrest. Bottom line, if someone points a gun at you and says "freeze", perhaps the best course of action is to do as the gun carrier says.
