“Continuing in the anecdotal vein, I was discussing this latest craziness with someone I know in law enforcement last night, and he told me how his Walther was stolen from his unlocked car about five years ago. Pretty irresponsible I thought.... it could wind up anywhere, involved in who knows what kind of crime. He said as much himself a second later.

A couple of years passed and he got a call from the local fuzz. Apparently there were two guys doing burglaries in the area and they had some sort of falling out, as criminals often do, and one shot the other with the missing Walther. So one is dead and the other is in jail.

By my understanding of the article, it would appear that instead of stopping as ordered by an armed man, they ran at him, and into HIS yard.

I do know of deaths described as suicide by cop, when an armed person threatens a cop in order to commit suicide..

But if the perp was running AWAY, there was no justification in shooting him. I would still go with a manslaughter charge, as I see no intent to kill, just to stop a robbery in progress and make a citizens arrest.

Bottom line, if someone points a gun at you and says "freeze", perhaps the best course of action is to do as the gun carrier says.

Works when the person with the gun is a cop, and is also given as your best chance of survival when the person with the gun wants your wallet.”

Well BB, assault rifles were created to shoot people, not deer, but as deer are approximately the same body mass as people they work just fine on deer.”
