Even then, if you say that people should be able to use deadly force to defend their property, you can't extend that to all property that you think might be at risk.”

“that will be what the Texas court will have to decide. Their new law does allow for you to extend the defense of property law beyond the home, but does it extend to property surrounding you or just you when in your car or business. I don't how screwed up the actual wording of that law is.”

“Where I live, the law enforcement is worthless.
Once my oldest step-son was driving a friend to someone's house down a dirt road. A dog ran out in front of him and he stopped the car. At the same time a man ran out of his house with a baseball bat and hit his car. He was about to get out of the car to confront the guy, then another group of guys came running out of the same house, so he just sped off and called 911 on his cell. When the deputy finally showed up at my house, he said there was nothing he could do, and he would not even ride to the house to find out what was going on or to see who did it. He said my step-son would have to find out who owned the house and take them to court.
Another time, my youngest son was at home with his girlfriend watching a football game. When the game was over they went into the front yard and was playing around with each other, laughing and giggling. A guy from a few houses down jumped in his truck, drove up in our driveway and attacked my son with a knife. He thought he was hurting the girl, but they both told him they were just playing, but he said that didn't matter. My son ran around the back of the house while the nut-case chased him. His girlfriend went into the house and called 911.
The guy with the knife fell, which gave my son enough time to get into the house and lock the door. He stayed on my property for about 15 minutes before he finally left. About 20 minutes later a deputy showed up. Again there was nothing he could do, because we did not have a "no trespassing" sign up, AND my son did not get stabbed. IF he was cut or stabbed, then they could arrest him. The deputy said he would go talk to the guy, which he did, and the guy admitted what he had done but nothing was ever done to him.
After a little investigating, we discovered the nut-case is a REAL nut-case. He was already on probation, he was drawing disability because he had mental problems' (even though he had a driver's license, worked out with weights everyday, was capable of chasing an 18 y.o. around with a knife)had a wife and 2 kids, and we were told we were lucky he did not stab himself when he fell, because he could have sued us.
So as you can see I have no faith in law enforcement. If I had been at home when this mess happened, there would be one less nut-case for anyone to worry about, and I would not lose any sleep over it.”

I know exactly what I'd do. Call 911 and stay in the house. From a legal standpoint he was justified. From a common sense standpoint he was stupid. The general rule is...avoid, avoid, avoid. If life is in threat...shoot, shoot, shoot.

Had things gone against this guy and he ended up dead we'd all be talking about how he did it to himself and how stupid he was.

1. Next time tell your son to call the STATE POLICE.

2. Get the Cops name in each case and send a complaint to the Chief/Sheriff with a CC to your City/County Representative.....

Where I live we only have the Sheriffs Dept. I don't live in the city, so we have no police dept or city council. Right now our sheriff is under investigation by the SBI. It's been all over the news locally. There are rumors about drug money, fraud, misusing funds, etc. So he really seems like a trusting guy.
Just for the record, my son, his girlfriend and my wife filed charges against the lunatic, had the court day set, all three of them missed a days work to go to court, but the case never came up! Why? Because the sheriffs dept said they could not find him!”

For who ever asked... I have held people at gunpoint as well as been held at gunpoint (both by cops and civilians, I had a misspent youth) It is NOT a joyous feeling. Its deadly serious, and anyone who can look down a barrel of a gun and still make an aggressive move has a few screws loose (or is a highly trained killer).

Also, the problem with people thinking that property isn't worth taking a life over is that it lessens a criminals it lessens a fear level such that they break into homes without regard to whether people are home or not. It makes them feel like they have the right to wave a gun in a store clerks face because the owner can just recoup his losses from his insurance company.

“I have a cousin who has had a criminal record since he was about 12. He is about 44 now. He has been in prison about 3 times. I can't count how many times he has been arrested and put in the county jails. He has been arrested in NC, SC and Tx. Some of his charges were: breaking and entering, simple assault, assault with a deadly weapon, drug possession, drug trafficking,dwi, shop lifting, not paying child support, and probably a few more I don't know about,but he always seems to get off easy by some technicality.
I have talked with him a few times about this and he just laughs it off, he acts like it is just a big joke. He said he had broke into a few homes over his life, but no one has ever confronted him with a gun. He acts like prison is just a summer camp. I wonder if he would have turned over a new leaf if a homeowner popped some lead in his a$$.”
