Scenario: You have the pistol you "aquired" in your car (in NM, you can carry it concealed in your car, place of business or home), when you are pulled over. You dutifully tell the officer you have a firearm in the vehicle, and he runs the serial number to discover the original owner has reported it stolen. You get handcuffed and your car gets towed. Big hassle, you lose the free gun and pay fines for towing, legal fees, bail (maybe), and whatever else. It's not illegal to lose a gun) and the Rio Arriba County Sheriff's Department actually entered the gun into the NCIC (which again, is somewhat far-fetched, considering the history of law enforcement in Rio Arriba Co.) then your point is well made. However, I don't carry a .22 in my car. It's mostly used for a hiking gun and occasional handgun-hunting for grouse. And, for the sake of argument, if the gun was in my bag while I was on my way to go hunting or hiking I certainly have no duty to offer up to a police officer the presence of a gun. That is a requirement in some states for the holders of concealed weapons permits. But a private citizen in a private vehicle with a privately-owned handgun that's out of sight doesn't have to disclose anything. And if the cop asks about guns, you have both the right to not answer the question--or lie! In New Mexico, it is against the law to file a false police report. It's also against the law to refuse to tell an investigating officer what you know about a crime that has taken place. It's even illegal to refuse to identify yourself to a police officer. But the state Court of Appeals has specifically upheld the right of a person to lie to a cop about just about anything else. So, in the unlikely event that I am pulled over while driving to hunt grouse and a cop in northern New Mexico asks if there's a gun in the car, I'd say no. If the cop wants to search my truck? Well, only a fool would allow a cop to look through their belongings without a warrant. You refuse the search. The cop searches anyway, without probable cause? Well, then, if the gun IS stolen (which, again, it is not) you have a problem that will disappear once the matter gets to court and a Fourth Amendment argument is made.” 12:37:24 PM 4/12/02 “Take it to a gun show, trade it to something else with a guy, not a dealer, no names, papers and you loose the tie and keep the equity. It was (almost certainly) lost, accidently, by another hiker. There are a few things I could have done: (a) left it where it was. The gun would have been covered in mud as the rain storm continued, certain to rust and be ruined. (b) taken it and turned it in to the most dishonest law enforcement department in New Mexico, members of which had been caught only three days before stealing guns from the evidence room. Keep in mind, it's 50 miles to Espanola, NM from the Truchas Peaks area. So I would have driven far out of my way to turn in the lost gun to a police department that would have likely stolen it. (Nah, don't worry about any forms, we'll hold it until the owner claims it...) (c)Kept it for myself. Finder's Keepers. (d) Hauled the gun off the mountain, taken it home and cleaned it up to prevent it from being rusted. Spent the rest of my summer searching for the owners: asking random hikers on trails "did you ever lose a gun while hiking Truchas? Yeah? What's the serial number?" And when I was unsuccessful, destroyed it because of the guilt invovled in owning a gun I didn't personally buy. I found a wallet about five years ago. It had about $120 in cash, credit cards, and a ATM card with the PIN number written on the back. What did I do? Tracked down the owner through the driver's license, called them and even delivered the wallet to the poor guy's house. I still would not have been able to walk away with it and not feel guilty. I might just have left it where it was, and if the owner hiked back to get it, so be it. If someone else picked it up, so be it. If it lay there and rusted into the earth, so be it. But if I did pick it up, I would have tried the nearest ranger station before the sherriffs. Gallatin. In that case, the Supreme Court upheld the right of officers to pat down (search) the person of anyone pulled over--deeming it necessary for officer safety.
