RE: NPS Violation Notice Via SnailMail
I got a Violation Notice through the mail from my friendly neighborhood Ranger Wilson for the charge...
36CFR 2.22(a)(2)
After some serious digging I came up with this...
2.22 (a)(2) PROPERTY

Visitors on overnight trips in the backcountry may leave their vehicles unattended for the period specified on their backcountry use permit in established roadside pullouts and parking areas.

Is anyone familiar with the CFR regs to know if this means anything OTHER than leaving a vehicle for longer than a specified time??? It mentions the Place Of Offense as a tract of land that had my Furnace Run geocache. The Offense Description says "Leaving property unattended for longer than 24 hours", but doesn't specify the cache. I'll park my vehicle for anywhere from 2-4 hours when I hike there but never for longer than 24 hours.

I also got a "Warning Notice" for another offense, 36CFR 2.1(a)(iii), for Disturbing/Removing Natural Objects (Fossilized Rocks).

I'm such a bad boy!

But I'd still like some imput! Anyone???

I'm no lawyer but it’s under the heading 'property'. The regulation spells out what property may be left unattended.

You might also want to review 2.15(a)(1).

permits
When we went into the Yellowstone backcountry for a 3 day trip a few weeks ago, we had to stop in at the ranger's office and get a backcountry permit. he gave us a tag to put on the truck dashboard because we were going to be parked for a few days.

For some more cache problems with rangers, this time in a forest preserve, look at the logs for this Chicago cache:

Chicago area cache

There's got to be some happy cache "middle ground" somewhere. What's the solution??

Buddur - That second post link is ugly. Where is this that they fine you $50 for use of a surfboard and 25 smackers for spitting? For unlawful sexual activity is 100 bucks. If it unlawful it must be with a minor or involve prostitution. For the first I hope they would do more than fine the SOB. For the second that doesn’t sound like much of a deterrent. What is the fine for picking your nose?

1. Cuyahoga Valley National Park, OH
2. The Furnace Run Geocache was an item I placed (about 1.5 years ago) in a remote region, and hidden within a short and small cairn. Ranger Wilson removed the cache on April 7.
3. NO, I did not remove any rocks from the park. Cobble-size glacial erratics, from the rocky Furnace Run stream, were used for the cairn. Some of them were fossiliferous, but as they are erratic and definitly were not insitu or even from the immediate area, I would have never thought of them as having geologic or archeologic significance.

We could make it a class action suit. Everyone who logged the cache against the Department of the Interior.

I could call one of George Bush's aides and use my political pressure, but us geocachers need a voice in the courts. Give 'em hell Buddur!

Did I mention that I have 21 days to pay my fine... And that the fine date says April 7th, but the postmark of the envelope says April 22, which means I really only have a few more days to pay the fine (which equalled a week from the time I received the notice).

Did I mention that Ranger Michael J. Wilson (CVNP#315) is a F'in Ba$turd!!!

I can't believe this Ranger hasn't anything better to do than follow a lame a$$ (no offense, lol) geocacher around and then go dig it up & THEN go write you up. Sounds like a vast left-wing conspiracy to me. First the SUV's, now this! Tell him Janet Reno's been replaced. I bet he thougt you might have had a little garden growin. When they see a vehicle out inna place like that, over & over, they revert to reefer madness mode.
