It's analogous to the folks suing the tobacco companies and firearms manufacturers. Some people seem to feel that someone else is responsible for their actions, so long as it will bring them financial benefit.

What about people who smoked in the 40s and 50s when tobacco companies were advertising that smoking cigarettes was good for you? They fought warning labels to the bitter end and produced tons of 'scientific' reports to undercut the growing evidence the tobacco could promote cancer, emphasema, heart disease...

What about the tobacco CEOs that blatantly lied before the Senate subcommittee? They should've been barbequed.

What about the firearms company in California with such lousy security that hundreds of pistols were stolen resulting in at least seven homicides?

What about the company that won't spend an extra Three Dollars so their automatic pistol won't fire when the clip is removed, a design 'feature' that has resulted in accidental deaths?

Tilt, the folks in the 40's and 50's who smoked may have a case but anyone who started smoking in the last 30 years has no excuse. Regarding safety features on firearms, it is common sense to treat every single firearm as if it were loaded no matter what.They arent toys, and ought not be treated as such.

It truly was a only a matter of time before someone sued the fastfood industry. I find the notion laughable that anyone would find DEEP FAT FRIED chicken to be a cornerstone of a healthy diet. Or that one could convince themselves that a super size big mac value meal is an acceptable meal in terms of nutrition or volume of food. The nutrition information is posted and available on request. Anyone with a 7th grade education can read the simple chart provided. Recall that a few years back taco bell had a "low fat" menu, no one wanted it so it was cancelled. Generally Americans dont give a flying fork about health or nutrition. If we did we wouldnt be the fattest nation on the planet. I say get off your fat @ss and eat a salad once in a while!

No one wants to responsible for their actions anymore, its always someone elses fault.

Another point to keep in mind is that fast food IS food. There are many in the world whose diets would improve if Big Macs were added. The same cannot be said about tobacco. It really is about calories - something which is efficiently transmitted in fat.

It is your fault if you are overnourished (IMHO).

To the contrary, tobacco companies hid evidence that nicotine was not only dangerous but addictive until very recently. If a company sells you a product which is known to be dangerous but hides the fact that you're likely to become hooked on that product, thereby greatly increasing the chances of your being harm by the company's deceit, the company is liable under basic common law fraud principles.

If someone tells you that inhaling a hot, burning vapor that makes you choke and cough is good for you, are YOU going to believe them? My mother smoked 2 packs of Winstons a day. One day my brother and I hid them from her and she went berserk. This was in the late fifties or early sixties. They didn't seem harmful to me then. Since the mid-sixties, cigs have had some kind of warning label on them. Anyone who has smoked for the last forty years has no excuse for their health problems.
Anyone who handles a firearm should at least have the dim understanding that it is a potentially lethal tool. I personally like the fact that my
Glock will fire without the clip in it. Your firearms ignorance shows when your speak of an 'automatic pistol'. Automatic weapons are forbidden to any civilian without a class 3 license.
'Accidental' deaths are caused by idiots, and I include in that group parents who do not teach their children firearms safety and who do not keep their firearms out of reach of their young children.
I smoke and I have a modest firearm collection. I also take responsiblity for my own actions. If someone steals one of my firearms, should I be held liable for what the thief does with it? I don't think so. If someone steals your car and robs a bank or commits murder (pick a crime) should you be held liable? Again, I don't think so.
People need to be held accountable for their own actions, my brother.

Yeah, there's not a whole lot of similarity between the tobacco industry and the fast food industry on the face of it right now... Of course, there are the studies on nutrition that the Restaurant Association tried desperately to put down. Those could be seen as somewhat analagous to the lies about nicotine and cigarrette additives.

If you're interested in the opposing views, here's a good book to read.

The problem is not inanimate objects like cigarettes, guns, or fast food. IMHO it is a trend away from individual responsibility and finding toward someone to blame for all your ills. This increases government regulation and power, takes away individual rights, and keeps lawyers employed.

This is a frivolous lawsuit that is only moving ahead because our society has let the legal system evolve into the quagmire that allows so many stupid things to happen...at our expense.

What I'm getting at is that if the owner is negligent, the piper should be paid. How should they be stored? What are the usual precautions? What is the law where you live?

The Original Comment was that suits involving tobacco and guns are just as frivolous as the Cheeseburger suit. I agree that some are, but some are definitely not. FG made a blanket statement which was begging to be challenged.

As far as the Gun Thing goes (and I've said this way more than once), I don't march along with Sarah Brady OR Charleton Heston. I think they're both out of synch.

I can't believe what America is turning into. come on who could honestly say that they didn't know that fast food was bad for you. The people that eat it all the time are just to lazy to get up and cook for then selfs. All of that talk that they are to busy is a crock. Bring a lunch with a good lunch fruit maybe a sandwich not McDonalds. I'm not going to say that I don't ever eat fast food. I think that some of it taste good. But maybe once a month or even less. America is sue happy and that is that. Everyone is looking for the easy money and doesn't want to work for it. What a crock of #&%!$!!!!

I don't think fast food is necessarily bad for you. You just can't eat two cheeseburgers, jumbo fries, chocolate shake and wash it down with a bucket of chicken every day for lunch.

Tilt, in answer to the storage question. Most gun owners I know lock their firearms in a gun cabinate. Not some display case that can be busted into with a stick, it's more like a safe.

Me personally, I don't own a firearm and don't intend to.

This lawsuit should result in a penalty to the plaintive for being stupid and annoying. The judge and court employees should be given a judgement for their pain and suffering in having to hear this case.

And yes, a Big Mac can kill you. The shock of seeing how many grams of fat and calories this meal packs will all but the most hardened (arteries) junk food eaters.
