“The Santa Clara County grand jury is investigating an incident in which members of a Yuba County sheriff's SWAT team allegedly tried to sexually assault one of their colleagues in a Morgan Hill motel room as part of a hazing ritual, sources said Thursday.

The alleged victim, Deputy Chad Ellis, filed a claim against Yuba County this week alleging that a lieutenant, three sergeants and three deputies were involved in the incident Sept. 24, 2003.

The Yuba County contingent was in Morgan Hill for the "Best in the West" SWAT team invitational competition. Ellis, who has been on the department two years, said his colleagues surprised him in his motel room, bound him with duct tape, punched and kicked him and pulled down his pants to sexually assault him with a pole.

The other SWAT team members stopped only when he suffered a torn muscle in his shoulder and screamed, said the claim, filed by attorney Joe O'Sullivan.

The attorney for the SWAT officers, Steve Welty, said Ellis' allegation that his colleagues had tried to sexually assault him was untrue.'

The incident was not a hazing, Welty said. "All that it was was a wrestling match -- it was horseplay. Unfortunately, Mr. Ellis injured his shoulder. It wasn't done intentionally.''

Ellis alleges in the claim that the other SWAT team members told him he was going to be sexually assaulted and showed him photos of an earlier such hazing. He took his concerns to Yuba County sheriff's Lt. Sean Smith, who told him not to worry, the claim says.

"Lt. Smith laughed and said he would protect Deputy Ellis," the claim against Yuba County says. "Lt. Smith was at the motel on Sept. 24, 2003, and allowed the attempted sexual assault to proceed.''

O'Sullivan said only the injury Ellis suffered and his subsequent screams stopped the plan from being carried out.

"They were pulling his pants down, they had already duct taped his ankles, they had deputies on both sides, they were attempting to put him in arm locks and he was biting them,'' O'Sullivan said. "That's when they pulled his arm out of its socket.

O'Sullivan said that none of the sheriff's deputies or supervisors involved has been disciplined. Ellis is on administrative leave.

To be honest, I read this story on another board. Sounds like a bunch of second rate guys trying to act tough and show some odd sense of "camaraderie" or something. Way over the line in my book.

LINCOLN, Neb. -- A rural Nebraska sheriff who spoke to a high school class handcuffed a student and broke the key, then had a welding shop remove the cuffs with a torch, severely burning the 17-year-old, the student's parents claim.

The torch caused third-degree burns to Seth Barrett's wrist, which later required surgery, Barrett's parents said in a lawsuit filed this week in U.S. District Court.

"The theme of this lawsuit is `What were you thinking?'" said Maren Chaloupka, attorney for Barrett's father, Elmer Barrett.

According to the lawsuit, Garfield County Sheriff Larry Donner was invited to speak to a Burwell High School class by his wife, who is a teacher, on May 13, 2002.

After his talk, Donner allowed some of the students to play with his handcuffs and Donner "handcuffed Seth as part of that horseplay," according to the lawsuit.

After breaking off the key while trying to remove the handcuffs, the suit alleges Donner took Barrett to a welding shop and had the cuffs removed with a plasma cutter -- an arc welder used to cut metal.

Donner then took Barrett to a local medical clinic, where he authorized treatment and the administration of a prescription drug for the burns, according to the lawsuit. Barrett's parents did not learn of the incident until Donner brought the boy home later that day, the lawsuit said.

The lawsuit, which seeks unspecified damages, accuses the central Nebraska county, the school and the welding shop of failing to protect the boy. It accuses Donner, his wife and the welding shop of interfering with the Barretts' parental rights by making decisions for their son's health and welfare.

Bill Wright, the attorney for the school, and Vince Valentino, who represents Garfield County, declined comment. Dan Placzek, the lawyer for the welding shop, Stalker Machine Inc., did not return a call seeking comment. It was not immediately known who was representing the Donners.”

What kind of cheapo cuffs was he using that he broke a key off in them? It doesn't take a rocket scientist to figure out how to use the things, and you would have to practically wrench the key violently to one side or the other to break it off in the lock. Fairly accurate representation of some of these country bumpkin local police. On the other hand (pun intended) I see no reason to sue the school and welding shop. The sheriff is ultimately responsible and should be the only one to have to pay. Typical shotgun approach to lawsuits.”
