Proper JusticeView Messages“Crowd Beats Motorist After He Strikes Boy With Car Posted: 10:27 a.m. EDT July 14, 2003 WEST PALM BEACH, Fla. -- A crowd in West Palm Beach reacted angrily when a motorist allegedly hit and killed a 3-year-old boy. Sheriff's officials say a group of men who saw the crash pulled the man from his car and beat him. The boy darted into traffic Saturday night and was struck by a car driven by 37-year-old Honorio Martinez. A sheriff's department spokesman says more than a dozen friends of the boy's father saw the crash and stopped the car about a half-block away. The men dragged Martinez out of the driver's seat and punched him several times. After the beating, Martinez walked back to see how the child was doing, then said he was leaving because he didn't have a driver's license. The men then beat him up again. Martinez has been charged with felony driving without a license that resulted in a death. Weylin Graham opened fire about 2 a.m. at Travoy and Devitri Santos, ages 26 and 25, respectively, at Emily and Atwater, said Saginaw Detective Sgt. Mark Lively. Graham likely died of a head wound, Police Deputy Chief Tom McGarrity said. The brothers are hospitalized at Saint Mary's hospital in fair condition. An autopsy is set for later today, Lively said. Medical Examiner Dr. Kanu Virani was out of town over the weekend, delaying the autopsy. McGarrity said police recovered a handgun at the scene. The victims were shot multiple times. A large group of people witnessed the shooting, but many left by the time police arrived Saturday, he added. McGarrity said finding suspects is proving difficult because no one is coming forward, and those who are have given conflicting reports. Police are asking anyone with information to call them at 759-1288 or at 759-1289. His sister, speaking in Criminal Court here during a sentencing hearing for Blanchard's attacker, said Blanchard has nightmares that either the man, Eric Erwin, or one of his friends will come back and finish him off. ''Mr. Erwin, as you approached my brother, what did you see?'' the sister, Dorothy Blanchard-Smith of Memphis, asked in court. ''Did you see a human being lying at your feet? Were you compelled by the disregard for human life or no regard for his? Could you not find an ounce of compassion for someone sleeping on (a) 20-degree slab of concrete?'' During the March 10 hearing, Blanchard-Smith said she wasn't interested in vengeance but expected justice to be served. She also wanted the maximum sentence allowed, which is three to six years in prison. Instead, Criminal Court Judge Mark Fishburn sentenced Erwin to four years of probation as to a plea agreement approved by prosecutors. Erwin and his attorney did not return phone calls seeking comment yesterday.
