Go backacking for the weekend, get sued.View Messages“I'd put the computer stuff out at the sidewalk, then call 'em up and tell 'em it's there and to come and get it! And I'd add, "You snooze, you lose!"” 11:02:27 AM 12/22/03 “LOL @ HPM..."but i left it at the office outside during business hours...seemed that no one was there"” 11:04:10 AM 12/22/03 Thanks everyone! “A big thank you to everyone who replied to this thread offering help. Support like this is what makes TT great! I'm going to keep up on the communication and try my best to get them their equipment soon. They are supposed to pick it up today by 1 before I leave for WV but it looks like they're not going to. Thanks again everyone!” 11:20:38 AM 12/22/03 “A contract is implied if there is a working relationship. They can press criminal (theft) and civil charges against you. I think you should stonewall them, sell the equipment on ebay, and then rot in jail. Good Luck!” 12:38:23 PM 12/22/03 “Dub, I think you should call their lawyer as often as possible and engage her in conversation just as long as you can. E-mail her too. She'll have to read them. Of course she will have to bill her client for her time.” 12:38:49 PM 12/22/03 “Ask her out on a date, and have her charge it to their account.” 12:41:07 PM 12/22/03 Ignore the letter and turn the tables on them. “Dear lawyer, Since your equipment was not picked up last Saturday, I am offering you another date to obtain the same. You may recover the equipment at _____ on _______ between the hours of ____ and ____. Your prompt attention to this matter will be appreciated. Sincerely yours, ---------------------------------------------------------------- Don't try to talk to their lawyer!” 2:37:47 PM 12/22/03 “I think Nowslimmer has the right idea. 8)” 4:15:32 PM 12/22/03 “I sent them an email similar to the one above after they didn't pick up their equipment as they were supposed to by 1pm today. I cc'd it to their lawyer and offered another date. I have not yet received a response from anyone.” 4:24:38 PM 12/22/03 How's THIS For An Idea... “Dub, what is this Co and their Email? Maybe some of us should set up a bogus Eaddress and Email them saying we have their computer equipment and since we're laid off we don't want the crap anymore and if they don't come to pick it up within a week it's going to the curb. What fun we could have!” 4:36:35 PM 12/22/03 “Dub, as others have mentioned, chances are they don't really want to hassle you, they just want to get the computer back and are too ignorant to do so in a reasonable way. You need to be reasonable, even if they are not. I'd be as reasonable as possible, and consider that your actions and correspondence are for three audiences: your former company, a future judge, and a future jury. Be nice. If they have given you their attorneys name, take the computer to their attorneys office and leave it there. I keep my emails, because I usually want to be able to prove what I said. Anything can be used as evidence. As for law, I'm sure glad I got into patent law. I'm going to present a case in front of the 9th Circuit where I represent a write of mountain bike trails in teh Sun Valley area. We won in Federal District Court, and I'm looking forward to winning in the 9th Circuit. But there are so many fields of law, and they are all very different.” 4:36:36 PM 12/22/03 “Idaho Bob, you make a good point. If they don't contact me over the break I will contact their laywer via the phone and see if she will allow me to drop it off at her office and offer me a receipt. Her office is on my way to school so I wouldn't have to go out of my way.” 4:39:03 PM 12/22/03 “LOL Budder....it might be fun until I'm slapped with a suit. Once this all passes I'd be glad to provide you with their information.” 4:45:05 PM 12/22/03 “Dub, box the puter up and email or call them and inform them that it is ready for immediate pick up. leave the puter by the front door for 30 days and wait - ignore any threats, implied or otherwise. the only response you should give for 30 days is "your equipment is ready for pick-up". Depending on the local laws after that the stuff may fall into abandonment. storage fees may appy as well. If they get to rambunctous threaten to counter sue.....If you really want to be nice offer to deliver it (maybe for a fee?)” 3:53:18 AM 12/23/03 “They are picking up their equipment here in a little bit (finally) and I'm not getting sued. However, they won't provide me with a document saying they picked up the equipment--I have to provide it. Any suggestions on where I could find a good example on the internet? Or could someone word one for me quickly? It doesn't have to be long.” 5:49:24 PM 1/15/04 “I hereby acknowledge receipt of the following property: [List each item in descriptive terms with SN]” 5:50:26 PM 1/15/04 “Have it signed and dated and have them print their name.” 5:50:54 PM 1/15/04 “Cool, thanks a lot Chili! That makes it short and sweet.” 5:53:00 PM 1/15/04 “I'm probably too late but add the line "All items recieved in proper working condition"” 8:52:06 PM 1/15/04 Wouldn't That Be Funny? “Wha'da'ya say in a few days from now I Email them with nasty remarks toward their gear? Oh yeah...and use the name Dub?” 9:06:54 PM 1/15/04 “LOL, they'd have no idea budder, but lets give it a month or two. Anyway, they picked up their equipment and signed the paper--it's finally over thank God. Hopefully I'll neve hear from them again.” 10:18:51 PM 1/15/04
