Robinson, 414 U.S. 218, 235 (1973). See also id. at 237-38 (Justice Powell concurring). The Court applied the same rule in Gustafson v. Florida, 414 U.S. 260 (1973), involving a search of a motorist's person following his custodial arrest for an offense for which a citation would normally have issued. Unlike the situation in Robinson, police regulations did not require the Gustafson officer to take the suspect into custody, nor did a departmental policy guide the officer as to when to conduct a full search. The Court found these differences inconsequential, and left for another day the problem of pretextual arrests in order to obtain basis to search. Soon thereafter, the Court upheld conduct of a similar search at the place of detention, even after a time lapse between the arrest and search. United States v. Edwards, 415 U.S. 800 (1974).” 5:43:27 AM 4/22/08 “Search Incident to Arrest.—The common-law rule permitting searches of the person of an arrestee as an incident to the arrest has occasioned little controversy in the Court.216 The dispute has centered around the scope of the search. Since it was the stated general rule that the scope of a warrantless search must be strictly tied to and justified by the circumstances which rendered its justification permissible, and since it was the rule that the justification of a search of the arrestee was to prevent destruction of evidence and to prevent access to a weapon,217 it was argued to the court that a search of the person of the defendant arrested for a traffic offense, which discovered heroin in a crumpled cigarette package, was impermissible, inasmuch as there could have been no destructible evidence relating to the offense for which he was arrested and no weapon could have been concealed in the cigarette package. The Court rejected this argument, ruling that "no additional justification" is required for a custodial arrest of a suspect based on probable cause.218” 5:44:41 AM 4/22/08 “tl; dr a simple yes wouldve sufficed” 5:44:53 AM 4/22/08 “yes!” 5:47:32 AM 4/22/08 “Wood Pleds Guilty To Forgetting 21lbs of Pot In Former Apt. http://www.kmvt.com/news/local/18953459.html” 6:51:53 AM 5/15/08 “How come he's not part of the Bush admenacetration? last edited: 5/15/08 7:01:10 AM” 7:00:45 AM 5/15/08 “forgetting that much smoke is definitely a crime” 7:11:57 AM 5/15/08 “must be good smoke if you forget where you left 21Lbs” 1:27:31 PM 5/15/08 Nice shirt! “ ![]() A river rescue turned into a river chase in west Reno around 8:30 a.m. on Tuesday. Blake Lister, 23, of Reno, was reported to be in trouble and screaming for help as he was washed down the Truckee River toward Idlewild Park. Reno Fire Department water rescue teams were called to the river to set up containment areas along the river downstream to save the victim. The man was not wearing a floatation device. Rescue swimmers were able to reach Lister but he allegedly resisted their rescue attempts. The man was heard singing and talking, so it appeared to firefighters that he was not in distress. Just above the Foster Street bridge, the man pulled himself onto a large rock near the river’s center revealing he was naked below the waist. The man appeared calm and in good humor as he tied a t-shirt around his waist. After singing to himself, the man leapt back into the river. Firefighters soon surrounded him and pushed him to shore. After a checkup at St. Mary’s Regional Medical Center, the man was arrested and jailed for indecent exposure (a gross misdemeanor), Reno Police Sgt. Dave Macauley said. No alcohol was involved but Lister’s mental state and possible drug use were in question, Macauley said. Lister had purposely jumped in the river at an unknown location putting himself and rescuers at risk. According to Macauley, after being pulled from the river Lister said, “I’ll never take drugs again!” source” 4:22:46 AM 5/23/08 “Ha hahahaha. Good one.” 8:04:42 AM 5/23/08 “Four people were arrested Wednesday night and accused of pointing a green laser beam at two passenger planes attempting to land at Cleveland Hopkins International Airport. The laser was also pointed at a police helicopter, temporarily blinding the pilot, and at a LifeFlight chopper that responds to emergencies for MetroHealth Medical Center. The police helicopter pilots said the laser beam entered their cockpit and struck the pilot directly in the eyes. The beam also created a disorienting matrix effect, with the light bouncing back and forth between the windows and control panels. "If not for the skill of our pilots, there could have been a crash," police Lt. Thomas Stacho said. Liana Wiemels, 25, of Parma Heights, and Brook Park residents Justin Dewalt, 24; Michael Wiemels, 19; and Charles Hendricks, 24, were arrested on suspicion of interfering with aircraft operations. [...] Patrolmen stopped a black Pontiac Grand Am. Dewalt, who was in the back seat, had a $500 laser device in a case and a marijuana pipe containing residue in his pocket, police said. He was also accused of having drug paraphernalia. The FBI is also investigating the airport incident. "If the case is handled federally, they face up to 20 years in prison," FBI Special Agent Scott Wilson said. "We take this very seriously." http://www.cleveland.com/news/plaindealer/index.ssf?/base/cuyahoga/1212741113106540.xml&coll=2” 7:44:18 AM 6/07/08
