He states this to the Attorney General: Our civilized society and legal system is based upon a respect for and adherence to the rule of law. The City and County of San Francisco's unfortunate choice to disregard state law and grant marriage certificates to gay couples directly undermines this fundamental guarantee. Thousands of people appear to be seeking the same unlawful certification as each day passes.


Then, he states this: California Gov. Arnold Schwarzenegger expressed support Sunday for allowing foreign-born citizens to run for president.

Schwarzenegger, a native of Austria, said in a television interview he would support rescinding the constitutional rule that only U.S. citizens born in the United States can become president.


WTF? You can't be gay and marry but you can be foreign and run the United States?

I don't see any difference between gay people wanting to change a law or him wanting to change a law. The only difference is that he cannot break the one he wants to change. So he has to "support changing it". If there were as many foreigners who wanted to be President as there are gay people who want to marry....

I guess we may get an Austrian born, or an Iraqi born president to run our country before american citizens Joe and John can be married. Makes sense to me.

There's nothing wrong with changing a law through the proper channels. I guess my problem with this guy is that his political career is all of 2 months old and instead of showing the state of California that he can solve their economic woes, he's making national headlines concerning changing laws about becoming the president of the United States.

Whoa, TB. As I understand it he wasn't going around advocating changing the Constitution so that he could run for president. He was asked by Tim Russert (I think, maybe someone else) if he favored that change in the constitution and he responded. Is he not entitled to express his opinion even? I wonld not be in favor of changing the constitution for that.

The constitution specifically states that no group can be given rights that another group is not. The mayor of SF is forcing the courts to examine the law defining marriage as betweeen a man and a woman.

Orin Hatch said he was joking when suggested a constitutional amendment to allow Ahnold to run for president. I wonder what he's thinking now, after this dust-up?


Seems like quite a few people in California are of the opinion that their state constitution's prohibitions against discrimination in all its forms trumps the proposition restricting marriage to heterosexuals.

Phaedrus, I am still not interested in it for myself. I don't agree with it for me. I support others but have reservations about its reflection on the very people who are doing it right now. I just hope that the majority who are "breaking the law", are doing so for the right reasons and not to just make a statement. But then again, making a statement sometimes needs the extremes to come out.

I really am not the best person to ask. I have not struggled for acceptance. I have not exploited myself. I don't seperate myself from society, period. I don't know what it is like to have to struggle with identity and try to make others join in the struggle with me. A lot of what goes on, it's about acceptance.

"Obviously" is a personal distinction, it's obvious to you - and many others. But it's also not obvious to many others - Or should I say it's "obvious" to them that no one is being denied equal treatment under the law. One needs to examine that other sides thoughts on the issue.

My posts aren't necessarily to show a bias to one side of the argument of whether or not gays should be allowed to marry. I'm just looking at if I'm a conservative justice looking at this case as an equal rights case... what do I see here. Unequal treatment...No... So I would say take it up with the legislature if you want the law changed.
