I don't think tort reform applies to malicious prosecution, but the problem with that action is the degree of malice that needs to be proved.

Most people can't even afford to fight false accusations b/c of attorney's fees.

North Carolina v Alford allows a Defendant to plead guilty, with a caveat that he is "not guilty" but pleads guilty b/c the risk of going to trial outweighs the decision to plead.

Slander laws get newspaper retractions in 6 font on the bottom of page 42.

Hardly compensates for the outrage headline in 32 font on page 1.

Hardly compensates for the job suspension, loss of wages, hate mail, ostricization with disgust by the public.

Slander only provides monetary compensation and sex charges are made by individuals with very limited funds in most cases. Even if the court does make a large award the likihood of collecting on the judgement is almost nil.

No, the falsely accused is ruined.

BTW, it is an interesting contrast where I am arguing for the Liberal viewpoint and you against Phaedrus.

Lastly, no, I have never been accused of misconduct, true or false.
I did witness the character assasination of Captain Hazlewood of the Exxon Valdez who later received the thanks of the Court in Alaska for preventing the disaster from being 10 time worse.
That was 100% about the company Exxon cutting costs at the expense of safety, and when the disaster occurred a successful 100% public relations shift the blame to an individual employee by the fat cats in headquarters.

More on the molester!
The Orange County Sheriff's Office said Thursday that it has received 24 complaints similar to Rivera's since the April 2 arrest of Michael C. Chartrand on charges that he molested a mother and daughter while he was in costume as the friendly tiger character from the Winnie the Pooh stories.

So far 13 of those cases are considered credible enough to be investigated actively, while the rest are being reviewed.

"I don't think it was a mistake," she said. "Everybody who goes through my photo album says, 'Tigger is groping you."'

Chartrand has been suspended without pay. Disney declined to comment on the latest allegations.

"It appears we have 24 folks that feel there may have been something inappropriate and that something happened to them," sheriff's spokesman Jim Solomons said. "It appears all of our complaints are focusing on Tigger."
