WASHINGTON - Supreme Court justices are weighing a lawsuit accusing the Bush administration of doing too little to protect undeveloped public land in Utah from off-road vehicles.

In oral arguments Monday, Justice Sandra Day O’Connor said she was disturbed by photographs of damage to the areas — a landscape that includes sand dunes and ancient stands of ponderosa pines.

Looks like they'll lose, they should have forced the DOI to take an action then sued. If Ginsberg's skeptical it don't look good.

Force the DOI? Easier said than done, isn't that true?

Possibly, I don't know why they would have sued if they felt they had other recourse... but who knows?

Hmmmm, this gives me ideas since the Forest Service is not enforcing the laws in the Monongahela NF.

How come Conservatives don't like the wilderness? Are they afraid of it or something?

The Republican National Committee announced today that the Republican Party is changing its emblem from an elephant to a CONDOM.

The committee chairman explained that the condom more clearly reflects the party's stance today, because a condom accepts inflation, halts production, destroys the next generation, protects a bunch of pricks, and gives you a sense of security while you're actually getting screwed.

A reprieve in New Mexico, though
Appeals court keeps BLM study area off-limits to off-roaders

The Associated Press

DENVER -- A federal appeals court on Wednesday refused to allow off-road vehicle groups to sue the Bureau of Land Management, which leaves a wilderness study area in New Mexico off-limits to the vehicles.
The 10th U.S. Circuit Court of Appeals in Denver upheld a lower court's dismissal of a lawsuit filed by the Southwest Four Wheel Drive Association and the Las Cruces Four Wheel Drive Club. The suit, filed in 2000, challenged the closure of most of the trails in the Robledo Mountains.
During oral arguments last month, the BLM said it closed the trails in 1997 because of damage to the land, part of an 11,640-acre proposed wilderness area.
The recreation groups argued the trails were public roads, protected under an 1866 law that allows states to claim rights to roads built over federal land. The law was repealed in 1976, but Congress said states and counties could continue using roads built before then.
Messages left with the Las Cruces Four-Wheel Drive Club were not immediately returned.

that case is actually kind of a big deal, seems like I've heard before that the opponents to the closure were fairly well funded and very vocal,

could be that I'm remembering something else though.

Its still a big deal.

If republicans remain in power, there will be no place left that isn't paved, mined, clear-cut, cultivated, grazed or transformed into muddy ruts.

Ahhhhhhhhh... and just today I managed to find my way into the area "Sekert Forest" I've been eyeing on a map forever....

yeah in my Jeep. The forest road wasn't too bad, but rutted and a wee bit scary for me in places.

In other words, it was fun!!

Yes, I am torn on off roading. I guess some places need to be open and some not. Wilderness, I guess not. (I was not in wilderness today.) And I love Utah!! I do recall being perturbed by the noisy ATVs at sand dunes state park near Zion -- and that IS a designated ATV area.

Still... I've never done any real hairy four-wheeling, but do think it's fun. :-)

You're right about that Uncliff. They aren't above making some nasty compromises; that's why I don't trust them. However, in my experience, the republicans are actively hostile.

Wilderness Bills?
Are these bills that allow people to wreak havoc on the wilderness or to protect it?

Local Story
People living near an old super fund site in Lackawanna County worry ATV riders could be stirring up more than noise. They're worried what the riders are doing to a cap that sealed the old landfill area.

Are ATVs Digging Up Dangers?

well about the place in Utah...i mean how much fun can it be to drive over a few hills...thats such lame ass offroading anyway...i wouldnt even waste my time there...and to the dumbasses riding round on the old landfill...well thats also just a few more stupid people fer ya....i cant believe that the EPA or even the county/state that maintain/ed/s that landfill would even think of allowing it...most of the ladfills that i have ever seen have fences around them...and most certainly when they are finished dumping there they have fences...i say fine any rider out in any area where there is potential for injury and or damage to natural terrain...come on people lets keep in mind that in the last 100 years we have caused more destruction to the earth than what has happened over billions of years prior...

I saw that story on TV the other day about the ATV riders ripping up the cap on the superfund site. It just shows you the brains or lack of that these idiots have to go riding on a mound of toxic waste. Forget about fences to keep them out. That's been tried on the watershed land and they just go around them or tear them down.

Forest meeting to look at recreation conflicts

By Cory Hatch, Jackson Hole, Wyo.
Date: March 27, 2008

A Bridger-Teton National Forest meeting tonight will address conflicts between users of motorized and non-motorized recreation.

In addition to garnering pubic input on access and protection issues in the Jackson, Buffalo and Greys River ranger districts, Bridger-Teton officials will discuss recreation conflicts and the need to protect backcountry areas near Teton Pass, Togwotee Pass, Cache Creek and Game Creek. The meeting is part of local Forest Service officials’ effort to develop a new Forest Plan.

Bob Hatton, owner of all-terrain-vehicle dealership Bob’s Quads, said he’s heard about some conflicts on the forest, especially between recreators using non-motorized transportation and snowmobilers in the Phillips Bench area.

“There’s a lot of conflict on Phillips,” he said.

Hatton said he has heard about some conflicts on Cache Creek trail but those seem to have lessened in recent years.

“The Cache Creek thing, they seem to have dealt with it pretty well,” he said. “I think the snowmobilers have been courteous of the non-motorized users.”
Tim Young, executive director of Friends of Pathways, agreed with Hatton’s assessment of both locations. He said signs have helped reduce incidents at Cache Creek, though he does hear of occasional conflicts.

“We continue to have close calls reported,” he said.

Young said wintertime conflicts near Teton Pass have become more prevalent now that newer snowmobiles have the power to access more remote areas.

“We have had incursions there into the Jedediah Smith Wilderness,” he said.
Today’s workshop will be from 6 to 9:30 p.m. at Jackson Hole High School.

For information on Bridger-Teton’s plan revision process, visit www.fs.fed.us/r4/btnf/news/forest_plan_revision/ or call Rick Fox, forest planner, at 307-739-5563.
