Federal Judge Calls 'Partial-Birth' Abortion Ban Unconstitutional

SAN FRANCISCO -- A federal judge Tuesday declared unconstitutional the Partial-Birth Abortion Ban Act, saying the measure infringes on a woman's right to choose.



U.S. District Judge Phyllis Hamilton's ruling came in one of three lawsuits challenging the legislation President Bush signed last year.

The ruling applies to Planned Parenthood clinics and their doctors, who perform roughly half the nation's abortions.

"The act poses an undue burden on a woman's right to choose an abortion," Hamilton wrote.

Federal judges in New York and Nebraska also heard challenges to the law earlier this year but have yet to rule.

Bush signed the bill in November, saying "a terrible form of violence has been directed against children who are inches from birth while the law looked the other way."

Guess where that goes next - the Ninth Circuit - which fortunately, assuming it affirms, virtually gaurantees a knee-jerk overturning by the Supreme Court.

The Supreme Court doesn't have to take it, but being this high profile a case they will.

If a more reasonable court affirmed this decision it'd stand a much better chance. getting cases from the Ninth Circuit (aka that bunch of nuts out west), tends to put a bad taste in the Courts mouth.

I haven't read about the decision yet but I bet the paper work for the appeal is on the way to the Ninth Circuit right now.

One question though, political discussions seem to go into chatter and flame, yet they can get quite nasty wherever they are. I can't seem to figure out the rule. This could be a civil political discussion here regarding abortion, why not let it be in chatter?

as i understand it,
fuego is specifically for the "chatter" that is about politics or religion, because those things seem to (de)evolve into heated arguments the quickest.

many peeps like the chit chat, but are sick of hearing politics and religion debated.

i can sorta understand it. i'm sure there are quite a few lurkers who just wanna read about BPing.

if you have all the boxes checked then usually the BPing threads sink pretty fast.
