None of this really harms my reputation, but is rather merely insulting or offensive.

The statement must be defamatory and must have been published to at least one other person, this forum takes care of that.

I am not really sure what any of you could say to me that would constitute libel, but keep trying.

Actually I was threatened by someone on ebay quite a few months ago for leaving negative feedback after they sold me used goods, saying they were new. It made me think about all the crap that is said on this message board, and I was wondering if anyone has actually been sued. The amount of money involved in a libel suit is usually a deterrent to filing, but it does happen.

Did you know that the statute of limitations for libel is 1 year?

To respond to the original question, yes, if other tests of libel are met, one could be sued for libel over the internet. It should be fairly easy, though, to establish that goods advertised as new on eBay were, in fact, used. Negative feedback should be based on fact, not some knee-jerk reaction, and clearly stated in the comments portion.

Have you ever read most negative feedbacks... they are very often knee-jerk reactions. The problem with feedback on ebay is that each person is trying to sell goods, and even though comments are factual, if they are said with the intent to harm someones business out of spite, then you can be held liable for libel.

The funny part of my story is that after this guy said he was going to sue me for merely stating the fact that he lied to me, he then left me a feedback that was completely false. I am waiting for the statute of limitations to expire (just to be on the safe side), and then I am going to file a small claims suit against him for my money. This person lives on the other side of the country, so it will a little more expensive for them to come to court, and hopefully they will pay up instead.

YAY lawsuits!

Needless to say, I will never buy or sell on ebay again, (in my humble opinion and with all due respect to ebay).

granted, this was a few years ago, but ive had no negative experiences buying or selling over ebay. everyone i dealt with was honest and fair, sometimes more than fair. i cannot recall any complaints regarding timeliness of payment or product, or quality of product, from either myself or the other party. and i made myself a nice few hundred bucks

Yep, you can sue for libel for stuff said on the internet.


Keep in mind that the federal Communications Decency Act of 1996, particularly Section 230, somewhat shields Web publishers like Matt from liability for libelous comments posted by third parties. The section states that "no provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider." By now, dozens of judges have taken a shot at interpreting that provision, and they have reached widely varying conclusions about what it means.

That is the problem prosecutor... It is my opinion and the opinion of others, that the company crash bang mentions above should not be entitled to that exclusion because they take part in the profits of each sale through commissions.

I had a great time buying and selling, until I got taken. I was very carefull, checked feedback, contacted before hand, ect... and still, I got taken.

Sods isn't a good place to go if you aren't prepared for freezing temps, wet bogs, river crossings, etc.

SNP would be a much better choice.

Even better choice is the Maryland AT. Try Pogo campground or Annapolis Rock view (no fires at anap rocks so kind of sucks) Maps and pics are at my site, www.marylandtrails.com

You would probably want either a good down 20 degree bag or a 0 synth this time of year.

Your tent is fine for this time of year.

As far as a stove, go get a sterno stove from Walmart, surplus store, etc and you will be fine.
