Living will?

I clicked on a thread about Jerry Fallwell and someone mentionned a 'living will' - in Québec it is called a 'Mandate of Incapacity'. I suspect this was at least mentionned on the Sciavo thread (which I have successfully avoided).

Well, when I started going crazy and talking about dying in the snow (or in class) my best buddy's wife, who is a lawyer, insisted I make a new, post-divorce will and a mandate.

Mine stipulates that I shall not be maintained alive by artificial means including intibulation and I'll donate all my organs to whomever wants them. I wanted it to state that I must not be rescucitated, but this is apparently impossible. I've told this story before, but when I told her about no rescucitation my buddy said, 'Hey, if you fall down right here I'll have to give you mouth-to-mouth.'

'If I wake up and your lips are on mine I'll have to kill you, MF (not that there's anything wrong with that, but I'm not ready).'

'Not untill I get a photo.' my lawyer remarked.

'Then I'll have to kill you too.'

'Never mind.' she said.

BTW, for all youse what have seen me at FYAO, at my last check-up my liver enzymes are normal and I could donate that too - but I'm thinking of buying a silver reliquary and sending it to Lourdes.

I think it's called a 'living will' because it states your intentions for medical treatment or non-treatment for while you are still alive for cases like the Sciavo one (assuming your question was serious, MarkO).

it designates who is responsible for making medical decisions on your behalf, if you are unable to do so.

A living trust (or at least a will) is a good idea, especially if you have children who are under 18. I am not an attorney, but with a living trust you avoid probate. Probate is the process the courts follow implement your will. (If you have children and die without a will or living trust, they become a ward of the state!...regardless of what you told your family and friends).

In a living trust you can express your desires about life sustaining measures and such. But when someone in your family is actually on life support, sometimes all the rules go out the window.

We have a handicapped child and have "Special Needs Trust" for her in our Living Trust. It protects her share of our estate and maintains her eligibility for other benefits if she should ever need them.

If you shop around, you will find the rates for living trusts vary tremendously. Some attorneys specialize in them and do a standard one at a reasonable price.

I read through my living will this week after watching the events of the Schiavo case unfold. Mine's about 7 years old, but I never really thought about it much until this week.

The following living will was passed on to me today. I find it quite interesting. I'm thinking of making a few modifications to my own living will.

I, _________________________ (fill in the blank), being of sound mind and body, do not wish to be kept alive indefinitely by artificial means.
Under no circumstances should my fate be put in the hands of a bunch of dumbass, ethically challenged politicians who couldn't pass ninth-grade biology if their lives depended on it.
If a reasonable amount of time passes and I fail to sit up and ask for sex, Rum and coke, or a cold beer, it should be presumed that I won't ever get better.
When such a determination is reached, I hereby instruct my spouse, children and attending physicians to pull the plug, reel in the tubes and call it a day.

Under no circumstances shall the hypocritical members of the Legislature (State or Federal) enact a special law to keep me on life-support machinery. It is my wish that these #&%!$s mind their own damn
business,and pay attention, instead, to the health, education and future of the millions
of Americans who aren't in a permanent coma.

Under no circumstances shall any politicians butt into this case.

I don't care how many fundamentalist votes they're trying to scrounge for their run for the presidency, it is my wish that they play politics with someone else's life and leave me alone to die in peace.

I couldn't care less if a hundred religious zealots send e-mails to Legislators in which they pretend to care about me. I can promise you, I don't know these people, and I certainly haven't authorized them to
preach and crusade on my behalf. They should mind their own business, too.

If any of my family goes against my wishes and turns my case into a political cause, I hereby promise that I will come back from the grave and haunt their ass and make, his or her, existence a living hell.
