True Story.

My first job I was friends with an ex-army ranger. He was among the first into Grenada. While we all laugh about Grenada being a real military action . . .he was medvaced after being fragged by a grenade.

Got a purple heart.

Anyhoo. He and another ranger buddy came out of a movie theatre with their dates and found 4 urban youths breaking into his bright yellow Camero.


They yelled across the garage for them to stop. The kids saw there was just two of them and laughed. The kids didn't leave, instead they confronted my friend and his buddy.

Two of the kids ended up with extended hospital stays. One with compound fractures of the arm.

The other two got off more easily.

The two that were in the hospital sued my friend. He had to get a lawyer to defend himself. The suit was thrown out. But the time, trouble, effort and expense, as well as the aggravation, and stress were all a pain.


this was in Stamford CT back in 1987.

Yes. You were probably within your rights. But you need to protect yourself from a legal perspective.

maybe mutt never really left?

granted, mutt seemed much more coherent, but maybe mutt never left. he just got bonked in the head by a falling tree branch and lost a few IQ points.

sarge, actually- i think i hope tree does forgive the guy. seems like everyone hopes tree forigves the guy. seems like everyone thinks forgiveness is a very good thing.

you seem to be confusing the act of tree forgiving this guy and tree appologizing to this guy. they are two very different things.

How is this: I agree with everything you have suggested. However, I would ONLY follow your advice under two circumstances:

1) under the advice of a lawyer

2) if, and only if, the statue of limitations for being sued civily had run out.




Again. Let's say I agree with you on the need to forgive. That is fine.

But I don't believe there is a need for Stu to compound his trouble by blithely giving this guy an open door to suing him.


I frankly think that would be just plain stupid.


I would rather not see Stu make a single further post on this thread.

lee - What I had imagined is stu apologizing to the thief, not in front of the entire court, judge, police force .... whatever. This isn't complicated.

The thief isn't going to say "Hey everybody, he just apoligized for hitting me!", and even if he did, he is just as likely to bring up the fact that stu hit him in court anyways ... so either way stu is going to have to either lie about what he did/didn't do in court, or fess up.

Apologizing to the thief will do nothing but good.

Oh wait, I forgot I changed my mind on this. treebeard ... Tell him you hope he rots in prison ... Forget this post.

sarge, my IQ is 148. I'm 6'3", 220 lbs with a 31" waist and a 13" ****. i love going for long walks on the beach and candle light dinners.
i'm not much of a talker, but i do like to listen. My favorite activities include building furniture and then having a lengthy disscussion about where to place it.

If he is sued and has made an apology, and then is questioned in court by opposing counsel, it could be made to be seen by the jury as an act of guilt.

Because I feel bad for hitting him.


Why did you feel bad? Was it because you picked up a weapon, approached him without warning, and caused him permanent disabling damage?



Its not that he didn't do it Sarge . . .its that he should not engage this guy on any level. Not in a name calling arguement, not to apologize until the dust has settled and he has absolute assurance that he can't be reached financially.

Personally it doesn't bother me that the guy got a swift kick. He might be a little more nervous next time.

I do think forgiveness and mercy, as Sarge suggests - is more likely to change his world view in this situation.

Lastly, I think it was foolish - it was a risk to you both in terms of your getting hurt and your getting legal problems. It's quite possible that he will try to use your assault as leverage to get you to drop charges.

I think no less of you because of this, and respect your honesty in examining and exposing this whole story.

Of course, all of us Wednesday morning quarterbacks find it easy to tell you what you should have done, so I might as well do so too.

If anything, stay a ways down the street like you were, and shout, "Hey, that's my car!" Chances are, the guy would simply not want to get caught and would just run away. Stereo still in car. Treebeard safe.

Getting close to the guy and engaging him in combat was incredibly dangerous. However, if you felt that hitting him was necessary for whatever reason, hitting him in the balls was a pretty good choice because it demonstrated that you had no desire to seriously injure him or kill him, but simply wanted to temporarily debilitate him until the cops arrived.
