Judge: Parents can't teach pagan beliefs

An Indianapolis father is appealing a Marion County judge's unusual order that prohibits him and his ex-wife from exposing their child to "non-mainstream religious beliefs and rituals."

The parents practice Wicca, a contemporary pagan religion that emphasizes a balance in nature and reverence for the earth.

Cale J. Bradford, chief judge of the Marion Superior Court, kept the unusual provision in the couple's divorce decree last year over their fierce objections, court records show. The order does not define a mainstream religion.
[...]
"When they read the order to me, I said, 'You've got to be kidding,' " said Alisa G. Cohen, an Indianapolis attorney representing Jones. "Didn't the judge get the memo that it's not up to him what constitutes a valid religion?"
[...]
At times, divorcing parents might battle in the courts over the religion of their children. But Kenneth J. Falk, the ICLU's legal director, said he knows of no such order issued before by an Indiana court. He said his research also did not turn up such a case nationally.

"Religion comes up most frequently when there are disputes between the parents. There are lots of cases where a mom and dad are of different faiths, and they're having a tug of war over the kids," Falk said. "This is different: Their dispute is with the judge. When the government is attempting to tell people they're not allowed to engage in non-mainstream activities, that raises concerns."

Sacco: if I think its crap that Kangaroos hopped from the where Noahs Ark landed in the Middle East to Australia after the flood and to no-where else - would it be okay for me (if I was a Judge) to forbid Biblical literalists from teaching that their beliefs to their children.

ped, christianity is a well established religion based on facts.

witchcraft is not.

furthermore, they're sentencing their children to hell.

So if I believe that Pagans will burn eternally in hell and that Kangaroos hopped straight to Australia after Noah's Ark came aground I am rational and my beliefs are based on facts, but if I believe in Nature spirits I'm bad and believe crap?

Is there a threshold in terms of survival or membership that dilineates a "well-established" religion?

If it's the age of a religion, then am I Okay if I worship Hera, since since her worship has been established for several thousand years? If its memebrship, tell me exactly when - say - Mormonism crossed over from cult to established respectable religion entitled to rights? How about Christianity? When did Christianity become an established religion entitled to rights?

This reminds me of a story that goes way back to Sunday afternoon. While on the top of Sam's Knob (a mountain in North Carolina) the boys and I came across a group of about 10 people meditating around a fire ring. The boys 11 and 10 which have been in Catholic school all their lives freaked out. We walked quietly past and I explained to them that those people are simply expressing their religious rights. The didn't bother me and I didn't bother them. The boys understood completely. I told them that many of our countrymen have died to give those rights to us and it is what our country is founded upon. Be not afraid of other religions, if they don't harm others just let them be.

Last month, Republican Congressional leaders filed into the Oval Office to meet with President George W. Bush and talk about renewing the controversial USA Patriot Act.

Several provisions of the act, passed in the shell shocked period immediately following the 9/11 terrorist attacks, caused enough anger that liberal groups like the American Civil Liberties Union had joined forces with prominent conservatives like Phyllis Schlafly and Bob Barr to oppose renewal.

GOP leaders told Bush that his hardcore push to renew the more onerous provisions of the act could further alienate conservatives still mad at the President from his botched attempt to nominate White House Counsel Harriet Miers to the Supreme Court.

“I don’t give a goddamn,” Bush retorted. “I’m the President and the Commander-in-Chief. Do it my way.”

“Mr. President,” one aide in the meeting said. “There is a valid case that the provisions in this law undermine the Constitution.”

“Stop throwing the Constitution in my face,” Bush screamed back. “It’s just a goddamned piece of paper!”

The part of the story pasted above is 100% unsourced, so unless the guy has some terrific track record of accurate reporting I don't know about, I have to agree with bacpac and SS.

I'd be interested in seeing evidence that Scalia and Gonzales said what the article claims they did.

Racist Man Sentenced To Attend Black Church

POSTED: 6:51 am EST January 16, 2006

CINCINNATI -- A judge has sentenced a suburban Cincinnati man to attend services for six weeks at a black church for threatening to punch a black cab driver and using racial slurs.

Judge William Mallory Jr. told 36-year-old Brett Haines, "It seems readily apparent to me that you don't like black people. That's OK with me. But you have to understand that you are at the whim and authority of a black judge."

This is a clear violation of church and state. Same as when someone who is convicted of an alcohol related crime gets sent to manditory AA meetings.

I agree - it seems unconstitutional to me. It will be interesting to see if the guy wants to fight it, or figures he could end up with something much worse.
