Alabama Outdoors wants to use one of my photosView Messages“They want to use one of my Sipsey pics from WebShots for their website. Alabama Outdoors is one of the better gear stores in Alabama. They asked permission and asked how I would like to be credited. What's the usual thing for this? How much depends on to what extent they are using your photo. I have a few of my images being used on websites but I'm happy to let them use it for free because they're not big commercial ventures. Is it a prominent photo used on the front page of their website for a long period of time, or a small image on one of the other pages? Shirley their markup is high so if you ask for a $100 credit, it only costs them like $50, depending on the type of item. Or you could just be greatly honored and not ask for anything. The photos were available to news media all over. I had a photo in the Des Moines Register. And who knows where else? I got a contract from Successful Farming, which is a big farming magazine, to run a photo or photos in there. And I blew my chance at more money. Man, I shoulda made ISU pay more!!! Live and learn.... Now a private land stewardship group wants a couple of the photos and offered $25 each. I'm offering them photos that I did not give to ISU, although they're similar shots. The offer was $25 apiece, which I figured, yeah, OK, they're shots I had on hand anyway. So your dad needs to be paid to level the playing field for all photographers. Freakin' Lanesboro is using ME!! They wanted a photo of an Amish buggy on a country road that I took to use on their website. I merely asked that I be credited and that if they wanted to run it elsewhere, that I be notified. I heard nothing more from them, although it's feature prominently on their tourism guide, a postcard, a relocation postcard and their website. ARGGGGH! I should be getting a bunch of moola from them! For a web publication, I'd consider how long they want the license for. Remember, you're not giving them the copyright, you're merely letting them use your work for whatever terms you agree upon. Also to consider is if they want exclusive rights to the photo. In which case the price just went way up. All things to consider. My local paper will run garbage in their paper for free before they will pay a pittance for a spectacular shot of the same subject. And the funny thing is, I think they figure they're really making out like bandits. Lizs, unless these people have a written contract with you, signed by you, granting them unlimited use, you do have recourse to recover your losses for their use of that buggy photo. And it extends way beyond just making them take it down or stop using it.
