It seems McKinney, currently the longest serving officer on the Capitol Hill police force, may lose his pension after 48 years of service. McKinney, a Navy Cross winner father of 8, a great-grandfather of 32, and recent great grandfather of 1, is accused of using the Congresswoman's hand to fend himself off from the Congresswoman. One Screw Up After Another “Congresswoman berates staffer as tape rolled after interview By BRIDGET GUTIERREZ The Atlanta Journal-Constitution Published on: 04/24/06 Move over Britney Spears, Cynthia McKinney's — oops! — done it again. The flap-plagued congresswoman, who has been in the media spotlight since she scuffled with a Capitol Hill police officer last month, was caught bad-mouthing a senior staffer Saturday. Unfortunately for McKinney, a DeKalb County Democray who is running for re-election in the 4th Congressional District, a TV microphone she was wearing picked up her indelicate grumbling. "Crap!" an irritated McKinney is heard saying after ending an interview with CBS 46 in which reporter Renee Starzyk repeatedly asked about the fallout from the police dust-up. "You know what? They lied to Coz and Coz is a fool." McKinney, apparently realizing her blunder, then returned to face the camera and tell the reporter that comments about her communications director, Coz Carson, were off the record. But the TV stationed aired the footage Saturday and the story later was picked up by CNN. Mike Machi, Channel 46's assistant news director, said McKinney's office was aware Starzyk would ask about the fuss in the one-on-one interview. "Congresswoman McKinney has been in Washington for a long time and she has handled the media for most of her public life," said Machi, who was unapologetic about airing the interview outtakes. "There were lots of ways to handle this and I was absolutely surprised that she handled this situation in that fashion." McKinney, who is expected to qualify for her U.S. House race today, could not be reached Sunday for comment. But Carson, who said he began working for the congresswoman a week before the pushing incident, seemed unbothered by the public upbraiding. "I share her frustration with the media's insatiable appetite for controversy and unimportant issues," said Carson, a former newsman who said he has known McKinney and her family for years. Carson said he was present for Saturday's interview, which took place during a community meeting with constituents, but declined to say what led to the rebuke. He also demurred when asked if he had spoken to McKinney about the "fool" comment. "I'll just say I look forward to getting back to work tomorrow," he said. Political observer Merle Black of Emory University got a chuckle out of McKinney's latest gaffe. But he said he wasn't surprised by her behavior, even in an election year. "All of this is consistent," Black said of the way McKinney has handled the attention, including her charges that the police incident was racially motivated. The controversial congresswoman from Georgia was even worthy of taking center stage at a rally at one of area's most identifiable events: the Sarasota Film Festival. But that was before McKinney was accused of striking a Capitol police officer and became this week's target for late-night comedians. Now, Democrats are doing everything they can to distance themselves from McKinney, including canceling the rally. It wasn't public pressure that caused the cancellation, said Democratic Party Chairman Henry Bright. It was the fact that McKinney was becoming too much of a distraction from the original reason they put on the rally: fair elections. McKinney is in town to promote "American Blackout," a movie she stars in that accuses Longboat Key Republican Katherine Harris of helping Republicans steal the 2000 presidential election for President George W. Bush. But the message of the movie was going to be overshadowed by McKinney's recent troubles, Bright said. Since March 29, McKinney has been defending herself for striking a police officer who tried to prevent her from walking past a security checkpoint. Members of Congress usually don't pass through the checkpoints, but McKinney wasn't wearing an identification pin that members of Congress are issued. McKinney called a press conference after the event in which she said she was a victim of racial profiling. McKinney is black. "This whole incident was instigated by the inappropriate touching and stopping of me -- a female, black congresswoman," she said at a press conference. Federal prosecutors are investigating the encounter. On Thursday, McKinney took to the floor of the House to apologize for the incident. "I am sorry that this misunderstanding happened at all, and I regret its escalation," McKinney said. But the latest apology wasn't enough to stop Bright from canceling Saturday's rally. Bright also said earlier press releases that called McKinney a heroine and included her name in big bold print didn't mean the rally was going to be all about her. It was the message of the movie she was involved in that was being celebrated, he said. Republican Party Chairman Bob Waechter said he was disappointed that Democrats were canceling their event with McKinney. "The Democrats choose odd heroes, and those heroes always seem to energize Republicans," Waechter said. Cynthia McKinney (D-Ga.), who could face criminal charges for striking a Capitol Police officer at a security checkpoint in March, has signed on to a resolution commending the police force for its “courage and professionalism.” Despite having maintained at the time of the incident that the officer touched her inappropriately and that he had failed in his duty to recognize her as a member of Congress, McKinney became a co-sponsor Tuesday of H.R. 756, which praises the force for providing “courteous, responsible and diligent services” and treating members “with dignity and respect.” The news, first reported by Atlanta television station WSB-TV, was the latest about-face for the Georgia lawmaker, who was at first spectacularly outspoken about the checkpoint scuffle, charging the officer with racial profiling. Within days, though, as the matter came before a grand jury for possible criminal prosecution, McKinney changed course and apologized for the incident on the House floor. The original co-sponsors of the resolution are Reps. Mario Diaz-Balart (R-Fla.) and Patrick McHenry (R-N.C.). McKinney came to the defense of the Capitol Police in 2001 shortly after the Sept. 11 attacks when officers were asked to work longer hours. McKinney was accused of striking a Capitol Hill police officer March 29, and the case was referred to the grand jury April 5. The drawn-out process of deciding whether she should be charged with assault has police fuming that the DeKalb County Democrat is getting preferential treatment from a politically motivated prosecutor. "Right from the start this U.S. attorney has handled this case differently from every other case," said Chuck Canterbury, national president of the Fraternal Order of Police. "And it's because she is a sitting congresswoman." McKinney's office and the office of U.S. Attorney Ken Wainstein declined to comment. The case comes at a time of heightened tensions in Washington. A series of arrests, indictments and criminal investigations involving at least five members of Congress have fueled disputes between Capitol police and Congress and between Capitol Hill and the Justice Department. Republicans and Democrats alike furiously denounced a recent FBI raid on the office of Rep. William Jefferson (D-La.) as a violation of the constitutional separation of powers. And Capitol police, already angry over McKinney's case, bristled when superiors ordered them last month to drive Rep. Patrick Kennedy (D-R.I.) home rather than investigate the possibility that he'd been drinking after he crashed his car into a barricade near the Capitol. Kennedy later blamed the incident on prescription drugs he'd been taking and checked into a rehabilitation facility. What most angers the police about the McKinney case is that it involves an assault — no matter how minor — of a police officer. Police reported that McKinney hit an officer in the chest after he failed to recognize her as a member of Congress and tried to stop her from going around a security checkpoint, something members of Congress and their aides are typically allowed to do. "It's obviously frustrating for us," said Andy Maybo, head of the Capitol Hill police union. "This sends out the message that it's OK to hit a police officer — and it's not, regardless of who you are." In legal terms, McKinney's case "is as simple as you can get," said George Washington University legal expert Jonathan Turley. Usually anyone who hits a police officer is immediately arrested on felony charges, police and legal experts said. In political terms, however, Mc-Kinney's case is far from simple. "It is loaded with emotion, and I think the U.S. attorney is being very, very conservative in how they approach this." Given the political sensitivity — made all the more delicate by Mc-Kinney's early accusations that she was the victim of racial profiling — legal experts said it's understandable that no decision has been made. "That would be unusual for a run-of-the-mill case, but this isn't a run-of-the-mill case," said Frank Carter, former head of the public defender service in Washington whose clients included White House intern Monica Lewinsky. He said many cases like McKinney's never reach a grand jury because they're settled quietly and privately, avoiding a public spectacle. "This ... begged for that," he said.
