FBI agents took Hsu into custody at St. Mary's Hospital in Grand Junction, Colo., said FBI spokesman Joseph Schadler. Hsu had been scheduled to appear in court Wednesday to turn over his passport and ask a judge to cut in half the $2 million bail he posted last week when he turned himself in after spending 15 years on the lam from a felony theft conviction. Instead, Hsu failed to show up at the bail reduction hearing and a judge issued a new arrest warrant for him. California Attorney General spokesman Gareth Lacy said Hsu's lawyers told prosecutors Hsu arrived by charter jet at the Oakland airport about 5:30 a.m. Wednesday local time and then wasn't heard from again. When it became apparent that Hsu had fled the state, California authorities sought the assistance of the FBI, whose agents arrested him Thursday night on charges of unlawful flight to avoid prosecution, Schadler said. Once he is returned to state custody, the federal charges will be dismissed, Schadler said. Meanwhile, Pennsylvania Gov. Ed Rendell became the latest of many Democratic politicians to return or donate to charity Hsu's election contributions. Rendell had said last week he planned to keep nearly $40,000 of Hsu's money even though he was wanted for failing to appear for sentencing after pleading no contest to a felony charge of bilking investors out of $1 million. "Though Norman is my friend, and remains so, his failure to appear casts a new light on his assertions regarding the original case," Rendell said in a statement before Hsu's arrest Thursday. "As a result, I will follow other elected officials and donate the money he contributed to me to charity." New York Sen. Hillary Rodham Clinton has said she plans to give to charity the $23,000 in donations she received from Hsu for her presidential and senatorial campaigns and to her political action committee, HillPac. The growing flap over Hsu's contributions prompted Democratic presidential candidate Chris Dodd to release a statement Thursday vowing "to refuse to accept or possess campaign contributions raised, solicited, or delivered by fugitives from justice." Edward Kennedy of Massachusetts ($35,000), Louisiana Sen. Mary Landrieu ($11,700), Montana Sen. Jon Tester ($4,750), Missouri Sen. Claire McCaskill ($20,700) and Pennsylvania Rep. Joseph Sestak ($2,500). Others have given their money to charity, including Manhattan District Attorney Robert Morgenthau, whose campaign received $2,000 in March from Mr. Hsu. William Jefferson, D-New Orleans, including the congressman's wife and brother and the former vice president of Nigeria. The information is contained in a letter from prosecutor Mark Lytle to Jefferson's attorney, Robert Trout. The letter was made public last week when attorneys for Jefferson included the letter as one of the exhibits attached to motions asking Virginia federal Judge T.S. Ellis III to drop 14 of the 16 criminal charges now pending against the congressman. Being listed as a co-conspirator doesn't mean that a criminal indictment will follow, but does indicate that the government believes the designated individuals were participants in what it considers an illegal transaction. Sometimes the government doesn't have enough proof to bring an indictment, in others it might choose not to file charges because the "co-conspirators" are cooperating with the investigation. The people named as co-conspirators either declined to comment, had their lawyers decline to comment, or could not be reached for comment. According to the Lytle letter, which was mailed Aug. 8, the government considers former Nigerian Vice President Atiku Abubakar and his wife, Jennifer Douglas Abubakar, among seven co-conspirators involved in a conspiracy to commit bribery and wire fraud and to deprive citizens of the honest services of a member of Congress and violate the Foreign Corrupt Practices Act. Investigators say Jefferson was videotaped accepting $100,000 from a government informant, Lori Mody, to bribe Abubakar, who at the time in the summer of 2005 was Nigeria's vice president. All but $10,000 was found by FBI agents in the freezer of Jefferson's Washington, D.C., home, which the congressman's attorneys say should invalidate the charge that he bribed the vice president and violated the Foreign Corrupt Practices Act. Abubakar has denied taking or soliciting bribes from Jefferson. Andrea Jefferson named The Lytle letter also names Andrea Jefferson, the congressman's wife, and two Nigerian business officials, Dumebi Kachikwu and Suleiman YahYah. In a conversation secretly recorded by the FBI, and revealed in court documents, Jefferson said that YahYah had "a lot of folks to pay off" to get iGate's telecommunications project operational in Nigeria. His attorney last year denied that YahYah had bribed anybody. A second conspiracy charge against Jefferson, involving six alleged schemes in Western Africa, lists six co-conspirators: Mose Jefferson, Jefferson's brother; Noreen Wilson, a Florida businesswoman; James Creaghan, a Louisiana lobbyist; George Knost, president of Arkel Sugar of Baton Rouge; and John Melton and Raymon Jarrell of TDC Overseas. Both Arkel and TDC Overseas are Louisiana businesses that pursued projects in Western Africa and which, according to the Justice Department, Jefferson agreed to assist in return for payments to family-controlled businesses. Vernon Jackson, CEO of iGate Inc., and former Jefferson aide Brett Pfeffer also are on the list. Both have pleaded guilty to bribery-related charges involving Jefferson. William Leone, the former U.S. attorney for Colorado who is one of eight federal prosecutors forced out of office by the Bush administration last year, said sometimes the government will list someone as a co-conspirator in order to justify getting their statements or evidence accepted at trial. Listing someone as a co-conspirator, he said, doesn't require the same "preponderance of evidence" needed to bring a criminal case, he said. Listing someone as a co-conspirator also can be used to pressure people to cooperate with an investigation, knowing that they could end up facing charges themselves, said Carl Tobias, a law professor at the University of Richmond. That obviously wouldn't apply for Andrea Jefferson, who under established jurisprudence cannot be compelled to testify against her husband. Some of those listed are already cooperating with the Justice Department probe, which began in March 2005. Jackson and Pfeffer, as part of their plea arrangements last year, agreed to cooperate with the investigation and testify at a trial against the congressman. Wilson, an investor in two companies that were seeking to develop oil reserves off the small African island nation of Sao Tome and Principe, testified at least five times before the Virginia grand jury that oversaw the Jefferson probe, according to documents filed by her lawyer. And Creaghan, the lobbyist who worked for Wilson, said in a statement issued by his attorney that he is cooperating with officials investigating Jefferson. Documents in the case filed by Jefferson's attorneys reveal that Creaghan, like cooperating witness Lori Mody, wore a wire to assist with the probe. Venue change sought In their motion before Judge Ellis, who is scheduled to preside over the Jefferson trial in Alexandria, Va., beginning Jan. 16, Jefferson's attorneys said the two conspiracy charges against the congressman seem intended to help the Justice Department overcome a lack of evidence, statute of limitations problems and a failure to establish venue. The attorneys called on Ellis to throw out 14 of the 16 counts in the indictment brought June 4 by the grand jury, including soliciting bribes and racketeering. The attorneys also asked that the case be moved from Virginia to Washington, D.C., alleging that the government contrived to schedule events in the case in Virginia so that it could try a case with a jury pool made up of fewer African-Americans than in the nation's capital. Jefferson is African-American. Hillary Rodham Clinton took another strange twist after he mailed a suicide note last week to a legal organization. A person who saw the letter said Thursday that the note from Norman Hsu explicitly stated that he "intended to commit suicide." The person declined to reveal the exact phrasing, but said it was not rambling in nature. The individual spoke to The Associated Press on condition of anonymity because he was not authorized to speak publicly about it. The letter arrived at the New York offices of the Innocence Project as Hsu was in the midst of a bizarre legal odyssey stemming from a 1991 grand theft case. Hsu has been wanted as a fugitive for missing his sentencing in the case. He failed to show up for a bail hearing last week in California and was arrested at a Colorado hospital after being taken off an Amtrak train. Hsu was a leading money "bundler" for Clinton, earning the title of HillRaiser for his efforts. Her campaign is returning $850,000 in contributions linked to Hsu. Innocence Project officials would not provide the specific details of the letter, but spokesman Eric Ferrero said a FedEx package arrived at the group's Manhattan office last Thursday. A receptionist gave the letter to the executive director, Madeline DeLone. "We were all concerned for his safety. We knew we needed to try to reach him right away. We wanted to make sure he was safe," said Ferrero. They tried Hsu's cell phone, but there was no answer and the voicemail was full. Innocence Project officials then tried to reach Hsu's attorney and faxed a copy of the letter to the California attorney general's office, which is handling the case. "We sent the letter to law enforcement in California in the event they could help him in time and also because they were handling an active case there involving him," said Ferrero. The letter was one page, typewritten and signed by Hsu. It was sent overnight delivery. Details of the letter were first reported Thursday by The Wall Street Journal.
