13 members get subpoenas in Wilkes corruption trial

Thirteen senior House members -- nine Republicans and four Democrats -- have been served with subpoenas from defense attorneys representing Brent Wilkes, the former defense contractor charged with bribing imprisoned ex-Rep. Duke Cunningham (R-Calif.).

None of the lawmakers will comply with the subpoena, according to an official notification read on the House floor Monday evening.

Wilkes is seeking testimony from all the lawmakers but after consulting with the House General Counsel's office, which advises lawmakers on legal issue related to their official congressional duties, the members declined to comply with the subpoenas.

The subpoenas were read into the Congressional Record late in the day's session, after the final vote, and the recipients include some of the top members of the House on both sides of the aisle. The list of members getting subpoenas includes: former Speaker Dennis Hastert (R-Ill.); House Minority Whip Roy Blunt (R-Mo.); Rep. Jerry Lewis (R-Calif.), former chairman of the Appropriations Committee; Rep. Duncan Hunter (R-Calif.), former chairman of the Armed Services Committee; Rep. Peter Hoekstra (R-Mich.), former Intelligence Committee chairman; Armed Services Committee Chairman Ike Skelton (D-Mo.); Intelligence Committee Chairman Silvestre Reyes (D-Texas); Rep. Jack Murtha (D-Pa.), chairman of the Defense subcommittee of the Appropriations Committee; Rep. Norm Dicks (D-Wash.); Rep. John Doolittle (R-Calif.); Rep. Darrell Issa (R-Calif.); Joe Knollenberg (R-Mich.); and Rep. Jerry Weller (R-Ill.).

On Face the Nation this morning, Hillary was asked about the Hsu contributions. When asked if her campaign would take steps to evaluate large contributers her response was...

"It wasn't only my campaign it was more than two dozen campaigns."

I think her implication was that all Democratic campaigns were corrupt.

Indictment names legislator, ex-councilman and former mayor pro tem

DALLAS — A meeting behind a church with $10,000 cash changing hands, five-figure gifts for a city councilman's "birthday party" and a mistress funneling bribes through a sham consulting company were among details spelled out Monday in a federal indictment alleging corruption at Dallas City Hall.

The 166-page indictment accuses state Rep. Terri Hodge, D-Dallas, and former Mayor Pro Tem Don Hill of extortion and bribery in soliciting and taking payments from affordable housing developers.

Former City Councilman James Fantroy was indicted separately on a charge that he embezzled more than $5,000 from traditionally black Paul Quinn College, where he was a director and treasurer of a program that received federal money.

In all, 16 people were indicted following an FBI-led public corruption probe that burst into view more than two years ago when agents raided city offices.

Hodge, Hill and others are accused of taking tens of thousands of dollars from real estate developer Brian Potashnik in exchange for helping his company obtain federal tax credits for low-income housing projects in predominantly minority neighborhoods.

"They extorted developers, and other times these developers would bribe public officials to obtain their support," U.S. Attorney Richard Roper said in a press conference.

The payments in the "complex and multilayered" scheme were designed to be difficult to trace, Roper said. They took several forms, including cash payments disguised as gifts, subcontracting fees and consulting fees paid to the city officials' associates.

In one instance detailed in the indictment, Hill is accused of meeting with two conspirators behind a church, where one handed him "at least $10,000 in cash" extorted from a developer. The indictment did not specify how much money changed hands but accused Hill of failing to pay federal taxes on $216,000 in unreported income between 1996 and 2004.

Prison System Supervisor Jeffrey Rush Allegedly Had Sex With Female Inmates

(CBS) CHICAGO The son of U.S. Rep. Bobby Rush was fired from the Illinois Corrections Department after serious allegations surfaced against him.

CBS 2's Joanie Lum reports, Jeffrey Rush is accused of having inappropriate and illegal contact with female inmates in his care.

Rush, 41, was an assistant supervisor of security at Fox Valley Transition Center in Aurora since 2003. The Chicago Sun-Times, citing sources familiar with the dismissal, reported Tuesday that he was fired Sept. 10 for having sex with female inmates.

The center is a state correctional facility, housing and training women just before they re-enter the community and the workforce. According to the facility's website, 117 women live there and can leave the premises for employment.

Jeffrey Rush is accused of meeting two women for sex outside the facility, which violates a state law forbidding correctional employees from having sexual relations with inmates.

Employees at the facility said Tuesday they could not comment about Jeffrey Rush and referred all inquiries to the director who is in Springfield.

Jeffrey Rush's father, Congressman Bobby Rush was in Washington, D.C. and issued a statement saying, "As a father, I am deeply disturbed and saddened by the allegations against my son, Jeffrey. I fully support him during these difficult times and my entire family remains in intense prayer for him and others who may be involved in this serious matter."

Governor Rod Blagojevich admits he helped Jeffrey Rush get the state job. After addressing a labor conference in Chicago Tuesday, the governor dashed away from reporters without taking any questions.

No charges have been filed against Jeffrey Rush.

Dodds legislation looks like a bail out for his lending buddies to get out from under defaulted loans.

The proposal has many flaws:

Like the Frank plan, it is essentially a government buyout of problem mortgages disguised as a refinancing plan. It is an extremely bad precedent, as lenders will quickly request that this guarantee be made available for all loans to borrowers with poor credit histories or lower incomes. Until now, the mortgage market has operated under free market–oriented principles with a moderate level of government regulation, but this program would be a slippery step toward government micromanagement. As a significant number of the loans now facing problems were made by irresponsible mortgage brokers using inaccurate and even false data, it would also signal that there are no real consequences for poor lending practices.
Many of these refinanced mortgages will be likely to default. The Congressional Budget Office (CBO) estimates that fully one-third of refinanced mortgages under H.R. 5830 (the Frank legislation) will subsequently default, and those numbers have been criticized by some as being overly optimistic. The risk of default is historically best measured by the size of a down payment. The smaller it is, the more likely that the borrower will walk away from the loan. While the Dodd plan essentially gives refinanced homeowners an amount equal to 10 percent of the current value of the house, this is a gift, and the homeowner has none of his or her own money at risk. Experience with similar "gift equity" programs already causing problems for the FHA shows that these loans have a default rate that is two to three times that of loans where the borrower has made a cash down payment.
The plan would reward two different groups of homeowners: those who took out a speculative loan they never had a chance of repaying in hopes of flipping the house in a rising market and those who fell into trouble through no fault of their own. In doing so, it sends a message that it is acceptable to renege on an obligation because a government buyout will cut your losses.
Even if legislation were passed tomorrow, it is not possible to implement this plan rapidly. FHA says that it does not currently have the people necessary to implement such a plan. It will take time to hire and train them. In addition, mortgages must be refinanced individually. It will take a great deal of time to refinance the 1 million–2 million loans that supporters say could benefit. While supporters talk of refinancing loans in bulk, this is not possible under current laws or industry practice, nor is it advisable.
The estimate for the number of homeowners who would be helped by the Dodd–Frank plan continues to drop. First, supporters claimed that about 2 million homeowners would have loans refinanced. Since then, that number has steadily dropped, and now the CBO says that only 500,000 loans worth about $85 billion would be refinanced over the next four years.
Borrowers with legitimate problems are already being assisted by the voluntary Hope Now program. In the first quarter of 2008 alone, the Hope Now program assisted over 500,000 homeowners—the same number that the CBO says the Dodd–Frank plan will assist over the next four years. The Hope Now program is certain to help even more homeowners than Dodd–Frank in coming quarters because it is already up and running. Dodd–Frank merely duplicates the existing private program at a cost of billions of dollars and transfers all risk of default to the taxpayers.
Dodd–Frank will not stop foreclosures, even for many who would otherwise qualify. During the time it will take to put the program in place, mortgage servicers will be legally bound to follow the terms of the existing contract for fear that the refinancing might fall through, including taking steps toward foreclosure. Further, as CBO points out, many lenders will refuse to take part because it would require them to accept heavy losses in order to participate. Other lenders who hold second mortgages on the same property could also block refinancing.
