San Jose mayor refuses to resign after indictment - 6 count indictment,, fraud, bribery ,conspiracy

Mayor Ron Gonzales rejected calls to step down after he was booked on fraud, bribery and conspiracy charges from a grand jury probe into a secretly negotiated garbage contract.

Gonzales, 55, was released on a $50,000 bond after being indicted on six counts Thursday for allegedly brokering a backroom deal that cost taxpayers more than $11 million. He refused to resign his post and continued to deny any wrongdoing in the scandal that has dogged him for nearly two years.

"The people of San Jose elected me to be the mayor of this town, and I am going to be the mayor of this town," Gonzales told reporters at a benefit dinner for a local education foundation Thursday night. He declined further comment.

His budget aide, Joe Guerra, and Norcal Waste Systems also were charged in the indictment. All three face arraignment Monday in Santa Clara County Superior Court.

Guerra faces charges of fraud, conspiracy and misappropriating public money, according to the indictment. His lawyer, Alan Lagod, confirmed his client was booked and released on bail.

The indictment named Norcal in four counts, including conspiracy, bribery and misappropriating public money. Its lawyer, Bill Goodman, said the company denied wrongdoing.

Gonzales also faces felony charges of misappropriating funds and falsifying public documents. He could be sentenced to more than a dozen years in prison if convicted, criminal experts said.

Prosecutors would not comment on the indictment. They scheduled a news conference Friday to discuss the results of the grand jury probe that had already led city councilors to censure the mayor last year.

The indictment alleges Gonzales pressured Norcal to recognize the Teamsters union at a recycling plant run by one of Norcal's subcontractors - a move the company said would keep labor peace but would cost millions more a year than planned. The indictment said Gonzales suggested to company officials that he could make the city reimburse Norcal.

The meeting constituted conspiracy to "cheat and defraud because from this meeting Norcal understood that Gonzales was offering to use his official position to persuade the City of San Jose to pay Norcal an additional estimated two million dollars per year."

The indictment alleges Gonzales then took an unspecified bribe from Norcal and conspired over the next four years with Guerra to make good on his plan.

Through an elaborate series of misleading statements and falsified public documents, the two convinced the council to approve the extra payments without knowing where the money was going, according to the indictment.

District Attorney George Kennedy said in December that he was investigating the deal Gonzales struck with Norcal.

At the time, Kennedy said that civil grand jury findings and those of independent investigator Chris Scott Graham raised "serious questions" about the dealmaking process.

Gonzales and Guerra treated City Council procedure as a "mere formality" and failed to adhere to the concepts of open government by forging the agreement, Graham said in the report.

A civil grand jury accused the two last year of "duping" the council into approving a 2003 rate increase and a 2004 contract amendment to cover $11.25 million in increased labor costs. Gonzales did not disclose to city councilors that $1 of a $1.40 per month garbage rate increase was intended to cover labor costs.

Gonzales has acknowledged that he agreed to the pay hikes without informing the council, but said members knew it was happening.

As word of the indictment spread, Vice Mayor Cindy Chavez and three city councilors called on Gonzales to step down immediately.

The indictment now promises to dominate the city's November mayoral race. Gonzales, whose term is up at the end of the year, is barred by city law from making a third run for the office.

Councilor Chuck Reed, who is in a runoff with Chavez to replace Gonzales, has based his campaign on cleaning up City Hall. He's painted Chavez, the mayor's appointee, as tied to a tainted administration.

"I plan to continue pointing out that the council terminated the Norcal investigation without clearing up the facts," said Reed, one of two councilors who dissented on the vote last year.

Chavez, who first supported the mayor when the allegations arose, on Thursday asked the City Council to convene a special session seeking Gonzales' resignation.

If Gonzales won't resign, Chavez wrote in a memo to her colleagues, the council should seek to restrict his ability to act on the city's behalf. She also noted that she would not seek to be named interim mayor while running a campaign for the post.

Gonzales' indictment may mark the end of a meteoric political fall. In 1998, he was one of the first Hispanic mayors of a major U.S. city.

In 2000, he addressed the Democratic National Convention in Los Angeles after being named one of 100 rising stars by the Democratic Leadership Council, a centrist group led by Sen. Joe Lieberman, D-Conn., then presidential candidate Al Gore's running mate.

Two months later, however, Gonzales' reputation sustained a major blow when he was forced to admit an extramarital affair with a 25-year-old subordinate.

Gonzales eked out a re-election victory in 2002, but the city soon struggled under the weight of record deficits following the dot-com bust. The mayor suffered a stroke during his State of the City address in 2004.

Since then, the city has been racked by a series of contract scandals, including a sweetheart deal requiring contractors to use equipment from local technology giant Cisco Systems for a new City Hall that has cost more than $500 million.

Democrat San Jose Mayor pleads not Guilty to Felony Counts

Mayor Ron Gonzales pleaded not guilty Wednesday to public corruption charges for his part in an alleged garbage-related scheme.

Santa Clara Superior Court Judge James Emerson set a trial date of May 14, 2007, nearly five months after Gonzales is scheduled to leave office. Attorneys on both sides said they'd need at least nine months to pore over more than 100,000 pages of documents and conduct interviews related to the case.

Prosecutors say Gonzales pressured Norcal Waste Systems Inc. into using Teamsters, instead of lower-paid union workers, at a recycling plant, and then secretly agreed to help the trash contractor recoup the extra labor expenses at a taxpayer cost of $11.25 million.

Gonzales was charged with six felonies in an indictment unsealed last month, including conspiracy, bribery, misappropriating public funds and falsifying records. If convicted, he could face up to eight years in prison.

Gonzales, 55, is serving his final year as a termed-out mayor in America's 10th largest city. He has denounced the charges as false and has vowed to finish out his term.

Dressed in a conservative black suit, Gonzales briskly walked out of the courthouse Wednesday and refused to comment.

Gonzales' lawyer, Allen Ruby, said Wednesday he will ask the judge to dismiss the case, but he couldn't elaborate because of a gag order in effect until at least Aug. 10.

The prosecutor, Julius Finkelstein, said there's "no legal basis" for dismissal.

"We think the charges are on very sound legal footing and are based on California and United States Supreme Court precedent," Finkelstein said.

The mayor's top budget aide, Joe Guerra, as well as lawyers for San Francisco-based garbage company Norcal, were indicted with Gonzales on June 21 for allegedly conspiring to defraud the public and misuse public funds. Guerra also pleaded not guilty Wednesday, and a Norcal representative pleaded not guilty on behalf of the corporation.

The indictment says Gonzales and Guerra agreed to pay millions of dollars in taxpayer funds to Norcal to help the company get through a labor dispute, but they failed to disclose that motive to the city council. Gonzales and Norcal, one of the largest solid waste companies in America, are also charged with bribery.

The handling of the garbage contract led city council members to unanimously censure the mayor in December. During a meeting amid hecklers and protesters at City Hall last month, the council passed a proposal asking the mayor to resign without declaring his innocence or guilt so that city business could continue without distraction.

Workers paid by a liberal group to register voters in Franklin County have turned in more than 500 forms with nonexistent addresses and potentially fake signatures, elections officials said yesterday.

Board of Elections Director Matthew Damschroder said he has forwarded the cards to county authorities for possible criminal charges.

Elections workers verifying new-voter forms discovered signatures with the same handwriting, addresses that were for vacant lots and incorrect information for voters who already were registered, Damschroder said. One card had the name of an East Side man whos dead.

All the questionable cards were turned in by workers for Ohio ACORN, a group thats also paying people to gather signatures for a proposed November ballot initiative to raise the states minimum wage.

Katy Gall, the groups head organizer, said ACORN is cooperating with the investigation and already has fired some of its paid circulators.

"We are interested in seeing people who are gaming the system prosecuted," she said.

ACORN, the Association of Community Organizations for Reform Now, faced similar problems in 2004 during a drive that added 189,000 new voters to Ohios rolls. Prosecutors were unable to trace the originators of some falsified forms, but one ACORN worker was indicted by a Franklin County grand jury.

State law now requires people paid for registering voters to add their own names to the forms. James Lee, a spokesman for Secretary of State J. Kenneth Blackwell, said the new provisions make it easier to investigate problems.

Lee said Blackwells office also has had inquiries recently about potential voter-registration fraud in Cuyahoga and Summit counties.

In its six Ohio offices, ACORN has about 50 circulators who are paid between $8 and $11 an hour, Gall said. The group has eight circulators in Columbus.

Gall complained that the states election-law changes make it harder for groups to catch problems because circulators must submit forms directly to elections offices in person or by mail.

In 2004, ACORN began running its own checks on voter forms before submitting them to the Franklin County Board of Elections.

Lee, however, said internal checks are still possible.

Its a felony in Ohio to submit voter-registration forms with false information. The penalty is up to 18 months in jail.

Damschroder said he doesnt think the fake forms were submitted by people intending to cast fake ballots in November.

"I think its just somebody out there trying to make a fast buck," he said.

ACORN is helping lead the coalition that collected more than 765,000 signatures to put the minimum-wage issue on the Nov. 7 ballot, but Gall said the group has no concerns about the signatures its circulators obtained.

Franklin County elections workers will verify those collected locally, Damschroder said.

Making Donovan Riley show a photo ID wouldn't have stopped him from having a second helping of democracy in 2000. A belief, engraved on his heart, that cheating's wrong would have done that.

I'm theorizing about its absence: So far, the lefty Democrat seeking to unseat his own party's state Sen. Jeff Plale (D-South Milwaukee) is merely accused of voting in both Illinois and Wisconsin. He's guilty of nothing but the weakest defense since President Clinton argued about "is." Riley says he forgot he'd already voted.

Whatever, since it appears Riley effectively has stopped campaigning. Now it's a matter for him and prosecutors. Running or not, however, he's still on the ballot, and it will be interesting to see how many votes he wins against Plale, who's bucked liberal orthodoxy on abortion, gun control and school choice in a district that includes the east side.

Riley was a test case on vote fraud, and so far, the left is flunking.

The right answer wasn't difficult. Riley, 69, runs under the slogan, "A Democrat who will vote like one." He apparently took that to mean "early and often." A group favoring school choice told the state that officials in Chicago said Riley voted in the Nov. 7, 2000, election there - and officials in Oconomowoc said the same thing. Riley's response was to say he may well have voted twice by "mistake." This seems inconsistent with the acuity one expects of former university hospital CEOs.

So calling him out should have been simple. His legal fate awaits due process, but he's not denying double-voting, which surely discredits his claim to a position of public trust. His opponent is an incumbent, union-backed Democrat. This was a cost-free chance for the left to say, publicly, that fraud so weakens democracy that even a whiff cannot be tolerated.

No such luck. State Rep. Tony Staskunas (D-West Allis) did last week, a one-man honor guard. But as of this week, the state Democrats' Web site still made room for Riley, touting his "Traditional Democratic Values."

It may be that Riley's been told by the party to slip away quietly, but that's how you spare the party embarrassment. Saying you take vote fraud seriously requires some noise from a podium.

Hearing none, voters can conclude that the Democratic establishment and its ideological friends don't see the danger. Through smokes-for-votes, through tire-slashings, despite thousands more votes cast in 2004 than voters registered, despite voters registered as living at parks, the left has insisted it's all confusion or tired poll workers, that fraud isn't a problem in Wisconsin.

It's like what some two-bit company would say when tests find traces of rodent droppings in the baked goods: It's so little, you'll never taste it through the frosting, so just ignore it.

Riley wasn't some get-out-the-vote worker paid in piecework. He was a polished, credible candidate who has as much as admitted to maybe voting twice. Plugging one's ears and repeating, "I don't believe there's fraud!" won't work with this many warnings going off.

The alternate conclusion, that the left really knows fraud takes place but finds it acceptable in the right cause, is risky. It's not necessarily justified yet - recall that Riley's running against a Democrat - and once people conclude one side will cheat, we're through as a republic.

But the left needs to drop the nobody-cheats line quickly. If photo ID wouldn't have stopped Riley, at least an Iraq-style purple finger would have, but we don't have even that. Demanding ID, meanwhile, is a reasonable precaution against other ways of cheating. As backers worked hard to accommodate objections - suggesting free ID cards for the poor, for instance - continued balking by the left suggests either blind faith or bad faith. Riley shows that fraud takes place. His supporters' silence shows that a swath of the political spectrum doesn't take it seriously. We can't ignore it until there's organized electoral theft. In saying he didn't find evidence of such theft in 2004, U.S. Attorney Steven Biskupic pointed out that vote fraud is hard to pin down. We should pay heed to what we do see.

We should remember, too, that even if fraud isn't massive enough to hijack the result, voting twice still amounts to stealing a vote - and stealing public faith in elections.

I am curious, however, if there are situations in which a person could, technically, vote twice legally.

I just remember a few years ago, when my wife moved from Wisconsin to Michigan, she moved on the exact day that determined full year citizenship in both states. So, for tax purposes, she was a resident of both states for the full year.

Like, say you timed your move for election day. You voted in the morning in your old residence. Then you drove your moving van to the Sec. of State and established residency in your new state that allowed same day registration.

Would it actually be illegal to vote twice?

Or say you moved from Oregon to another state. They have mail-in voting for like a month prior to election day. Is it illegal to vote early, change residence and vote again somewhere else?

Even voting for president wouldn't necessarily be voting twice since we don't actually vote for a president, but presidential electors. It would be two distinct elections.

Oddball thought.

I always thought it would be fun if someone figured out how many absentee Florida voters had died prior to election day in 2000.

reformed....when you get a voter id you are certifying that you have residence in that area....since you can only reside in ONE place at one time (we are talking by the cut off date which is what a month or so before the election) this makes it Voter Fraud.

I have a close friend who watched as his Mother voted three times after her death. Turns out some of the friends of the left were using her address and name and picking individuals out to go get them an extra vote.

The perfect solution is that, once they are caught and convicted, the individual loses the right to vote, FOR EVER. They become classified a Resident Alien meaning they can live here but are ineligible for any Government Free Money service programs like Social Security, Medicaid, Medicare, etc etc. Additionally any previous monies paid into the system or other beneies....like military service history are stricken. For all intents and purposes they are no longer a citizen.

if i was obsessed by political crap as much as you and s-rge and stove and violin and buddha bear, i could find examples of some conservatives doing this or something as equally underhanded in an election. it seems like you people dont even give a sht about the issues anymore and are just hellbent for leather on bashing the opposite side of the political fence

Democrat Cooper charged with fraud, conspiracy

State Sen. Jerry Cooper was indicted Tuesday on charges of bank and mail fraud as well as conspiracy concerning a questionable land deal, according to the Associated Press.

Cooper (D-Morrison) has been a member of the General Assembly since 1985 and currently serves as chairman of the powerful Senate Commerce Committee.

The indictment, which was not available to The City Paper at press time, ends speculation that has hung over Cooper for more than a year but adds to the list of current or former state lawmakers who have been charged with wrongdoing.

Last year, Cooper was listed as an unindicted coconspirator on a 2005 indictment that said Cooper would and did use his political contacts, connections and influence to help a defendant, Anthony Auyer of Alabama, obtain a loan to buy a lumber mill in 1999.

Cooper owned that lumber mill.

Auyers loan that Cooper helped him obtain was for $1.77 million. The loan came from BankTennessee, which Lt. Gov. John Wilder (D-Mason) partially owns.

Cooper sold the lumber mill to Auyer for $1.3 million after the loan was obtained. Cooper used $800,000 of that $1.3 million to pay off a mortgage.

Auyer and his wife, Teresa Auyer of Alabama, both pled guilty earlier this year to multiple counts of fraud and conspiracy. Auyer has been sentenced to nearly three years in prison, while his wife will serve a year and half.

An appraiser, James Passons, who was also indicted, was acquitted.

The 2005 indictment alleged that Passons doctored the appraisal to make it seem that a rail spur was present on the property when in fact it was not.

The rail spur, which is a road connecting the mill to the railroad, was believed to be essential to the value of the property.

Records show Cooper got a state grant to build the rail spur to aid economic development in his district, which is southeast of Nashville, as well as obtaining a $485,000 equipment loan from the state.

However, the rail spur was never built.

Cooper is the sixth current or former lawmaker indicted in 2005-06.

Last year, the FBIs Operation Tennessee Waltz charged five current or former lawmakers with accepting bribes to influence legislation.

Of those five, former state Rep. Chris Newton (R-Cleveland) pled guilty and is serving time. Former state Sen. Roscoe Dixon (D-Memphis) was convicted and is awaiting sentencing.

Former state Sen. John Ford (D-Memphis) and current Senators Kathryn Bowers (D-Memphis) and Ward Crutchfield (D-Chattanooga) are awaiting trial.

I was more curious than anything about this. I did a little bit of searching on this and found that most states bar you from voting in another state during the same election via statute.

But let's say you are a campaign worker for a presidential candidate. The primaries run from January until June. Could you participate in a January primary, move to another state, vote in a February primary, move to another state...?

Longtime Bronx State Sen. Efrain Gonzalez will surrender to federal authorities today to face charges of misappropriating government funds, the Daily News has learned.
A sealed 19-count indictment reportedly charges Gonzalez with using grants and contracts acquired for various community groups to siphon money back into his own pocket. One group named is the West Bronx Neighborhood Association, an alleged dummy organization.

The indictment stems from a two-year probe by the FBI and federally-deputized agents from the city Department of Investigation. Investigators sifted through a "massive" number of records and traveled to Florida and the Dominican Republic, where Gonzalez has a cigar business, a source said.

Gonzalez, 58, a state senator for 18 years, is to turn himself in at the U.S. attorney's office in Foley Square at 9 a.m., sources said.

"We have not been appraised of the charges," Gonzalez's lawyer, Murray Richman, said last night. "Before we can comment, we want to review them."

Richman said that U.S. Attorney David Kelley's office had agreed Gonzalez could be released on $25,000 bond.

The investigation has been the buzz of the Bronx political establishment since it began, with rumors flying that it extended to other elected officials and the Bronx Democratic Party machine. But a party insider said that, at this point, "no subpoenas, no paper requests, no nothing, has gone out beyond Sen.Gonzalez."

The Bronx's political reputation has taken a beating in recent years, with former state Assemblywoman Gloria Davis and former state Sen. Guy Velella both convicted and jailed for bribe-taking.

The orange and blue stripes on my Detroit Tigers cap are the only stripes I need.

But let's say that you voted in a senatorial election in the year 2004. Then, you moved to a state that was having a senatorial election in 2006. You would conceivably have voted in elections for three or even four current Senators.

There's no law against that. It's just the natural ebb and flow of people.

And if I'm correct, the Constitution gives over most election law to the states.

Some of these laws have, in the past, allowed double voting. If I remember correctly, New Jersey used to allow a person to vote twice if given power of attorney by a relative.

I would seriously doubt that there is a constitutional prohibition to voting twice. And I could see some quirks existing in the state election laws that might allow someone to vote twice legally.

Shoot. I'll give you an even better example.

In the year 2000, Michigan had a Democrat presidential caucus and a Republican presidential primary. They were on different dates.

This allowed every Michigan resident the chance to participate legally in the selection process for both major parties. Note: Michigan does not require declaration of party status to vote in a primary. So it is perfectly legal for Republicans to vote in Democrat primaries if they want to or vice versa.

Most people didn't do this because the Democrat caucus was a foregone conclusion for Gore and because, well, it was a caucus. But I'm sure there were a few people who did this legally.

The funny thing is that John McCain ended up winning the Michigan Republican primary in 2000. If the Democrat primary had been held on the same day, Bush would have won because the exit polls clearly showed that Republicans voted for Bush.

Without Michigan in 2000 and "double voting", the monster that is John McCain would have basically been slain.

Voting twice - a great American tradition!!

Federal Probe Launched Into Menendez's Finances

A federal investigation has been launched into the financial dealings of New Jersey Sen. Robert Menendez and a nonprofit agency he has helped over the years, sources said.

The U.S. attorney's office has subpoened the agency's records pertaining to a house once owned by then-congressman Menendez, sources told NewsChannel 4's Brian Thompson.

AP New Jersey GOP state senator alleges Menendez violated House ethics rule

TRENTON, N.J. (AP) _ A Republican state lawmaker alleged Thursday that Democratic U.S. Sen. Robert Menendez violated ethics rules by trying to block a merger involving a company in which he holds stock.

State Sen. Diane Allen, R-Burlington, said she planned to file a complaint with the Senate Ethics Committee early next week. Menendez served in the House for 14 years before being appointed in January by Gov. Jon Corzine to serve out the remaining year of his Senate term.

Menendez is locked in a close race with Republican state Sen. Tom Kean Jr. Both campaigns have traded ethics charges.

Allen alleges that in 2003, Menendez sponsored legislation to ban media mergers he said would create monopolies in Spanish language broadcasting. Allen alleges Menendez wanted the merger to fail because his stock would have gone down. The merger ultimately went through.

"Ethics rules say you cannot lobby on behalf of organizations when you stand to make some money by it," Allen said. "I fear that Sen. Menendez has trouble discerning that line between what is ethical and what is not."

Menendez campaign spokesman Matthew Miller said Menendez, along with other Democratic lawmakers, fought the "mass media consolidation because it hurts consumers."

Kean campaign spokeswoman Jill Hazelbaker said this is just another example of Menendez "using his public office for personal gain."

According to Menendez's latest financial disclosure form, he holds stock in Florida-based Spanish Broadcasting System Inc. worth between $1,000 and $15,000. SBS is the largest Hispanic radio broadcasting company in the United States. Menendez has received nearly $25,000 in campaign contributions from SBS and its executives, according to documents filed with the Federal Elections Commission.

Former NJ Senate president pleads guilty to tax, fraud charges

NEWARK, N.J. (AP) - A former New Jersey Senate president who wielded enormous power over the state's Democratic political machine pleaded guilty Friday to fraud and tax evasion charges involving his efforts to help a Middlesex County company get a project approved.
John Lynch, a former mayor of New Brunswick, admitted in court that he accepted $25,000 from a South Brunswick sand mining company in return for helping the company in its efforts to build a recreational park.

He also admitted failing to declare $150,000 in extra income he earned in 1999.

The payments from the unnamed sand company took place between March 1998 and February 2002, according to court documents. In return, Lynch took a number of actions, including sending a letter on official state Senate stationery to the Department of Environmental Protection, vouching for the company's proposed project.

Lynch's business dealings had been under scrutiny for months as prosecutors apparently probed whether he used his political influence to earn money. The FBI last year searched the Tinton Falls offices of Executive Continental, a consulting firm that Lynch owns with John E. Westlake.

Lynch pleaded guilty to one count each of tax evasion and theft of honest services through fraud. Each count carries a possible federal prison sentence of five years, and a fine of up to $250,000. He is to be sentenced Dec. 19, and was released until then on a $100,000 personal recognizance bond.
He did not speak in court other than to answer, "Yes, your honor" to a long series of questions about his conduct.

Lynch wielded heavy influence over state politics as a state senator, New Brunswick mayor and chairman of a political action committee, New Directions for Responsible Leadership.

But he recently announced he would resign from the PAC because "too many of my friends and colleagues have had their businesses suffer or their reputations impugned simply because they know or support me."

He was New Brunswick mayor from 1979 to 1991, a state senator from 1981 to 2002 and Senate president from 1990 to 1992.

He was a mentor to former Gov. James E. McGreevey, though the two had a falling out during McGreevey's stint as governor.

After his office was raided, Lynch released a statement that said, "I am sure that I have been repeatedly investigated due to the repeated press accounts calling me a 'boss,' a 'warlord,' and many other uncomplimentary names as a result of the nonsense perpetrated by people associated with the McGreevey administration."

He went on to say, "I have done nothing improper and I am sure that any investigation will come to that conclusion."
