Bob Menendez's close ally invoking the powerful Democrat's name while pressuring the doctor to divvy up county contracts, he and several others said Wednesday. Dr. Oscar Sandoval, who bribed and then helped imprison a former county executive, said he made tapes that back up his earlier allegations that attorney and Menendez friend Donald Scarinci ordered him to share his county jail contracts with another physician, or else lose them. Scarinci suggested that he was relaying the wishes of Menendez, Sandoval has alleged in court papers. "There is a tape in which Donald Scarinci refers to Menendez," said Sandoval's lawyer, Tomas Espinosa. He added, "There is more than one tape." Sandoval would not detail the contents of the tapes other than to say they would be damaging to Menendez, a longtime congressman appointed to the Senate in January and now campaigning for a full term. Several Democratic insiders confirmed Sandoval's characterization of the recordings. One person close to the Menendez campaign and familiar with some of the content called it "really embarrassing" to Menendez. But a spokesman for Menendez distanced the senator from any comments Scarinci might have made on tape. "If your report is accurate, it shows Scarinci speaking for himself and himself only, not for Bob Menendez," said the spokesman, Matt Miller. Scarinci could not be reached for comment Wednesday. In March, the attorney called Sandoval's allegations "ridiculous." With the election a little more than a month away, Miller blamed the Sandoval revelation on the "smear machine" working for Republican Senate candidate Tom Kean Jr., who has repeatedly accused Menendez of corruption. Kean's spokeswoman could not be reached for comment. "Oscar Sandoval seduced one of his psychiatric patients and used her to bribe a public official for millions of dollars in contracts," Miller said. "He has no credibility." To keep his profitable contracts for psychiatric services at the Hudson County Jail, Sandoval passed bribes to County Executive Robert Janiszewski through his paramour-patient, then-Hudson County Freeholder Nidia Davila-Colon. Sandoval ultimately cooperated with federal authorities in the prosecutions that put both officials in prison. Sandoval made inflammatory claims about Scarinci and other Hudson County political figures in a countersuit filed earlier this year, and Espinosa said he might add Menendez as a defendant in the matter. The claim responded to Hudson County's suit against Sandoval, which sought to recover losses due to corruption under Janiszewski. Among numerous other allegations, Sandoval's countersuit claims that Scarinci contacted him in 1999 to tell him that "then-Congressman Robert Menendez would very much appreciate if Dr. Sandoval would rehire" a doctor whom Sandoval had fired. Scarinci suggested that he would protect Sandoval's contract from Janiszewski if he did as he was told. "The protection furnished by Scarinci to Dr. Sandoval was at the price of making Dr. Vicente Ruiz Dr. Sandoval's equal partner in the contract with the county and in any future product of Sandoval," the countersuit alleges. It adds that Ruiz told Sandoval that he must split the proceeds of the contract "three ways" among "himself, Ruiz and the last part for Scarinci and Menendez." The Sandoval papers further allege that Menendez personally appeared at the end of a meeting of the two doctors with Scarinci in the lawyer's office "and stated that he was glad we could work out our difference and could work together." But Menendez's spokesman said the senator "doesn't recall ever being in any such meeting." Miller added of Sandoval, "He's being sued by a county trying to get money back that he stole. I'm not sur- prised that he'd make outlandish claims." Sandoval said Wednesday that he had released the contents of one tape to a newspaper. He said he has other, more damaging tapes that he also plans to publicize. As news of the tapes spread Wednesday, some Democrats grew concerned about whether their contents could damage Menendez's candidacy. One insider said the tapes would cause Menendez real political trouble, but added that the senator's campaign plans to respond aggressively. Another Democratic insider said the tapes might offer little more than a textbook example of classic Hudson County political swagger with no evidence that Menendez played a role. "This may just be another Norcross scenario," this person said, referring to South Jersey Democratic power broker George E. Norcross III. In tapes that surfaced during last year's gubernatorial campaign, Norcross boasted of a close relationship with Jon Corzine, then a Democratic U.S. senator seeking the governor's office. Corzine won the election and appointed Menendez to serve the last year of his Senate term. Corzine, however, had an up-and-down relationship with Norcross over the course of a relatively short political career. LOUIS - Election officials say hundreds of potentially bogus registration cards, including ones for dead and underage people, were submitted by a branch of a national group that has been criticized in the past for similar offenses. At least 1,500 potentially fraudulent registration cards were turned in by the St. Louis branch of the Association of Community Organizations for Reform Now, or ACORN, leading up to Wednesday's registration deadline for the Nov. 7 election, said Kim Mathis, chairwoman of the St. Louis City Board of Election Commissioners. Invalid registrations solicited by ACORN workers included duplicate or incomplete ones, a 16-year-old voter, dead people registering, and forged signatures, Mathis said. "Fifteen hundred may not sound like a lot, but it is a big deal and it disenfranchises the election process," she said. "It's time someone be prosecuted. There's a lot of taxpayer dollars being wasted on this." Scott Liendecker, director of Republican elections for St. Louis, said his office will turn the matter over to the U.S. attorney's office for possible prosecution once a final count of potentially fraudulent submissions is finished next week. Mary Wheeler-Jones, the Democratic elections director, said she does not dispute the accusations against ACORN. ACORN spokesman Brian Mellor told the St. Louis Post-Dispatch, which first reported the potential fraud, that prosecution could be warranted. "We try very hard to monitor the employees, but there are chances of things slipping through," Mellor said. He did not return calls from The Associated Press. ACORN, founded in 1970, sends paid and volunteer workers around cities to sign up new voters. The group ran voter registration drives in Missouri and 16 other states this year. Similar allegations have been made in Pennsylvania, Ohio and Colorado, though no charges have been filed. This year in Missouri, ACORN has turned in about 40,000 new voter registrations. Half of those were in St. Louis. The other 20,000 were collected in the Kansas City area, according to election officials. Four ACORN workers were fired over a September 2003 incident after the St. Louis board pointed out more than 1,000 questionable new voter registration forms collected by ACORN. ACORN registered more than a million U.S. voters in 2004, when it also had to defend itself against fraud allegations. The plea ends Hevesi's 35-year political career and wraps up an investigation by Albany County District Attorney David Soares, who had been presenting evidence about Hevesi to a grand jury. Hevesi, a Democrat from New York City, will serve no jail time. He agreed to pay a $5,000 fine and to not file any appeals. He also agreed not to take office on Jan. 1. Hevesi was re-elected in November amid the scandal, and state lawmakers had considered removing him from office. "I want to apologize to the people of New York state who have given me the opportunity to serve them," Hevesi said after a court appearance. "I want to apologize to the 2,400 professionals who work in the comptroller's office and I want to apologize to my family who have been so strong and loving during this process." In court, Hevesi acknowledged that he used a state employee to provide services for his wife that "could not be properly characterized as security" during 2005 and 2006. Hevesi admitted to defrauding the government, a felony that carries a maximum penalty of 1 1/3 to four years in prison. He must submit DNA for the state's databank and is scheduled to be sentenced Feb. 9. Hevesi, 66, was elected state comptroller in 2002 and re-elected in November by a wide margin despite several investigations into his use of four employees to cater to his ailing wife from 2003 to mid-2006. In October, with Hevesi coasting to a re-election win, the bipartisan state Ethics Commission said the driving arrangements violated state law. Most of the driving was done by Nicholas Acquafredda, who also helped Carol Hevesi with errands and even helped with physical therapy. What also will likely be seen this week in her handling of the Conyers scandal is whether or not Pelosi means what she says about cleaning up the ethics mess left by the Republicans (and not a few prominent Democrats as well). Rep. John Conyers, D-Mich., is scheduled to become chairman of the House Judiciary Committee, but only because he agreed when Pelosi previously made clear that she intended him not to waste time on impeachment proceedings against President Bush. But now we learn that Conyers has his own problems with obeying the law. There is so much wrong with the Conyers situation that Pelosi shouldn’t have to think twice about nixing Conyers’ chairmanship. Let us look at how the Conyers scandal epitomizes the ethics mess in the House: First, releasing its report late on Friday before the New Year’s holiday weekend made it clear that the House “Ethics” Committee intended to minimize public understanding of the Conyers scandal. This is classic Washington Establishment manipulation of the news cycle to insulate itself against public accountability. Second, Conyers responded to the “Ethics” committee by “accepting responsibility” for a “lack of clarity” in asking aides to work on his re-election campaign while on the official payroll instead of going on a campaign staff, as the law requires, and to do personal chores for him. The allegations came from senior staff members, including a former chief of staff, not interns or other short-term aides who might have questionable motives. Third, the “Ethics” committee report also concerned a second investigation of Conyers from 2003 on allegations that his aides also worked on the Carol Mosely-Braun presidential campaign and JoAnn Watson’s Detroit City Council race. Would Conyers have applied the same slipshod legal standards to his Bush impeachment effort? Fourth, the Conyers scandal shows it’s still business as usual for the “Ethics” committee. Pelosi should demand that Rep. Doc Hastings, R-Wash., and Rep. Howard Berman, D-Calif., the committee leaders who signed off on the Conyers report, be removed permanently from the panel and barred from leadership of other House panels. Finally, Pelosi should heed former White House chief of staff and ex-congressman Leon Panetta, who said “you can attack one party for having a lack of ethics, but if any of your own members have problems, it dulls the message with the American people, they begin to put everybody in the same box.” In other words, whenever one member of the House has an ethics problem, it damages the credibility of all members of the House, including most especially its most visible leader, the speaker.
