Camper sues government over stumble

Friday, August 04, 2006

Here's a tip for campers on the go:

Bring a flashlight when wandering in the woods.

Jerry Mersereau, 23, learned that lesson the hard way when he trekked out in the dark to relieve himself and fell off a cliff in the Mt. Hood National Forest.

Ouch.

Tucked into his lawsuit (Jerry Mersereau v. United States of America) is this succinct description of his misadventure: "While finding a place to relieve himself, plaintiff walked off the unguarded and unprotected cliff falling approximately 20 to 30 feet to the creek bed below."

Now Mersereau wants the U.S. government to pay for his injuries and the "mental anguish" his fall has caused. He says the government should have known the cliff posed a danger to campers.

Yeah - how come wilderness experiences don't come with guard rails and warning signs, alarm boxes, pay phones and sidewalks - paved roads for ambulances and other essential safety stuff?

Without a flashlight, how would he have seen the sign? I suppose the park should have a streetlamp shining on the sign?

I've never been there, but I googled up some images of Mt. Hood National Forest. It sure looks like an area you could get hurt walking around in the dark.

I hope the jury gives him the death penalty.

Well Hyway, obviously there should have been guard rails and the signs should be lit up. What about our inalienable right to have a wilderness experience in safety?

How do you just walk off a cliff? I mean, even if its dark out, can't you see that there's nothing in front of you?

Has anyone checked this guy's blood-alcohol content? :)

Dang almost as glad a some doofus not preparing for say Life, education or a natural disaster, refusing to take actions to prevent the disaster or leave the area....and then demanding "MOMMY GOVERNMENT! take care of me"

The sad thing is this guy represents a growing majority of people who want someone else to pay for their stupidity.

WOW...that is a bit of a thread redirect..(LOL)...I am trying to figure how someone (person ONE) not taking responsibility for natural consequences and therefore demanding another human change their life....or END it to satisfy person One's egotistical needs....

its quite possible if we had more abortions we might have less stupid people. I say this since most people who want an abortion are correcting what they consider stupid mistakes. therefore, stupid people aborting stupid babies makes for less warning labels for the rest of us.

LOL....and then there is the ROE Effect where liberal women are still getting abortions but the conservative women are having kids.....

Then again we do need stupid people to give society something to entertain us. Where would we be if The Idiot had been bred out of us. No morons to make Darwin Awards...nah these are the true entertainers.

Cussler lost me when he had Dirk Pitt make out with the old chick in the floating bathtub. I can only suspend disbelief so far.

Raise the Titanic? Sure. Dirk Pitt making out with an old woman in a floating bathtub with an outboard motor on it in the Florida Strait? Naaaaaahhhh....

I made a mental note of where the edge of the world was when I camped in Savage Gulf many months ago. I can for sure see how easy it would be to take a "hee-yawhhhh!" off the edge when going out in the pitch dark to take a leak. I recall reading this happens on a regular basis and that is why they ban hiking after dark. I was very impressed with the emphasis on safety at that facility... very impressed.

and you were camped very near the drop off point that last night.

There should have been a warning sign not to stick you feet to close to the fire though. MOOOOOOO HAHAHAHAHAHA!

this is exactly why we have steps in national parks now and why roots and other "tripping hazards" are spray painted bright neon orange...these people need to stay out of the wilderness

In GSMNP some of those new steps on the AT are almost impossible for me on my poor knees. I may have to carry a small ladder or ramp with me.

As far as the orange paint, I have not seen any yet. Some trail sections with many roots and rocks would require the orange paint across the entire trail.
