In addition, the judge held that federal law grants exclusive and private control over the waters of the river, outside the main shipping channel, to riparian landowners. The shallows of the navigable waters are no longer open to the public, the MRAA reports,

Private property rights over public good. A judge backs up arrests by a Southern Sheriff acting on a complaint from land owners. Sounds more conservative than liberal.

I can't swear that I understand the decision, but I think some new legislation is in order - or maybe just a clearer ruling.

LOL...I wonder if we are ever going to get the whole "separation of powers thing" working. The best thing is when the courts start legislating is to have the executive branch NOT enforce the Court decision...NEVER happen? ask the Cherokees.

Judicial restraint will occur when a few senators begin IMPEACHING Judges...(LOL) see old Ruth Bader sitting there trying to explain how she can Constitutionally justify using International law to enforce US Constitutional law....You burn a couple (lose job, pension, law license) the rest will start reading the law instead of creating it.

Hey now, lets stay on topic here. The judge is the one who issued the ruling. I see no connection between that and Clinton or bush pretty much ignoring the law. Maybe it's just me.
