THE BEST CASE for Senate Minority Leader Harry M. Reid (D-Nev.) is that he was sloppy about financial disclosure rules in accounting for a real estate deal on which he made a $700,000 profit. The more unattractive case is that the senator's inaccurate description of the investment was an effort to disguise his partnership with a Las Vegas lawyer who's never been charged with wrongdoing but whose name has surfaced in federal investigations involving organized crime, casinos and political bribery since the 1980s. As of now, the evidence points toward sloppiness; Mr. Reid's friendship with Jay Brown isn't exactly a secret in the state. But either way, an Associated Press report about Mr. Reid's dealings doesn't cast the senator in an attractive light. Neither does his response to the AP story, which indicates a casual disregard for the importance of accurate reporting of lawmakers' financial affairs.

Mr. Reid bought undeveloped property on the outskirts of fast-growing Las Vegas for about $400,000 in 1998 -- one parcel outright and a second jointly with Mr. Brown. In 2001, Mr. Reid sold the land for the same price to a corporation he co-owned with Mr. Brown, who in the meantime was getting the land rezoned from residential to commercial use. But the senator didn't report the sale on his annual financial disclosure form. When the new company sold the land to developers in 2004, yielding $1.1 million for Mr. Reid, the senator did not accurately list the transaction or go back and fix the previous forms to reflect the new arrangement.

"Everything I did was transparent," Mr. Reid said at a news conference Wednesday, after the story broke. "Everything is fully disclosed to the ethics committee and everyone else. As I said, if there is some technical change that the ethics committee wants, I'll be happy to do that."

Mr. Reid's professions of transparency and full disclosure are transparently wrong. His investment was not reported in a manner that made clear his partnership with Mr. Brown. It's true -- under the inadequate financial disclosure rules -- that even if Mr. Reid had listed the newly formed corporation, Patrick Lane LLC, that wouldn't have by itself demonstrated Mr. Brown's involvement. Nonetheless, that Mr. Reid no longer owned the land, but instead had sold it for an interest in the Patrick Lane corporation, was not some mere "technical change," as the senator would like to brush it off. It's an essential element of financial disclosure rules, the purpose of which is to know how and with whom public officials are financially entwined.

A lucrative land deal benefiting U.S. Senate minority leader Harry Reid (D., Nev.) deserves full scrutiny by the Senate ethics committee.


In 1998, Reid purchased undeveloped residential property on the outskirts of Las Vegas for $400,000. He bought one lot outright, and a second lot with a partner, Jay Brown. In 2001, Reid sold the land for the same price to a corporation created by Brown. Reid retained an ownership stake in the corporation and continued to pay taxes on the property. There was no written agreement; Brown told the Associated Press that the two had been friends for 35 years and didn't need one.

So the Senate Democratic leader engaged in a seven-figure handshake and didn't feel the need to disclose all the details. Experts on Senate ethics rules say Reid should have disclosed the sale in 2001 on his annual ethics report, and informed Congress of his part-ownership in Brown's corporation. Reid didn't.

After the land was rezoned for a shopping center, the corporation sold it in 2004. Reid received $1.1 million in the sale, turning a neat profit of nearly $700,000 in six years.

While now insisting he did nothing wrong, Reid is also offering to make a "technical change" to his earlier ethics reports if the ethics committee so desires. Simply giving the Democratic leader a mulligan is hardly the way to handle this case. When the Senate debated ethics reforms earlier this year, Reid was out in front to demand the toughest of standards from lawmakers.

"Americans have been shocked and even disgusted by revelations of corruption in our current system by Republican lobbyists, senior Bush Administration officials, members of Congress, and former congressional staff," Reid said in March. "The scandals have shown that some outsiders and insiders believed they could act with impunity."

That's how this case looks, too. Unless Reid comes up with a better explanation for this lack of disclosure, Democrats should not keep him as their leader in the new Congress in 2007.

Senate Democratic leader Harry Reid would be well advised to stop thundering about corruption in the Republican ranks or crying "cover-up" over the GOP's failure to promptly and appropriately deal with former Rep. Mark Foley (R-Fla.) and his sexually explicit e-mails to congressional pages. Reid faces too many questions about his own behavior to crusade against the misdeeds of others.

Currently, he's trying to explain a land deal in Nevada on which he made a pile of money and which may not have been properly disclosed. When the property was sold in 2004, it belonged to a company formed with a long-time friend and included a parcel that once had been owed by Reid. Despite having transferred his parcel to the company, the Nevada Democrat continued to report in Senate documents that he still owned it personally. That's a breach of Senate disclosure rules, according to the Associated Press, which first reported the transaction details.

Reid is now considering whether he should amend his disclosure statement.

Two months ago, the Los Angeles Times reported that Reid had smoothed the way for a campaign contributor and friend to develop a huge tract of land northeast of Las Vegas. Reid tried twice — before he was successful — to get a utility right-of-way moved from the proposed development site onto public land.

The first effort stalled because of objections from the Bureau of Land Management and others that the developer wasn't going to pay anything for a deal that would greatly increase the value of his development site. Eventually, it was determined the developer should pay the federal government more than $10 million.

Then there are the free boxing tickets Reid took from the Nevada Athletic Commission. The panel was hoping to block formation of a national boxing commission; Reid favored one.

Only after the Associated Press reported this summer that Reid got the expensive tickets did the senator decide he would no longer accept such gifts.

Unfortunately, Reid's ethics meter only seems to work when it's too late.

Reid acted several days after The Associated Press reported the senator didn't disclose to Congress that he first sold the land to a friend's company back in 2001 and took an ownership stake in the company. He didn't collect the seven-figure payout until the company sold the land again in 2004 to others.

Reid said his amended ethics reports will list the 2001 sale.

"I directed my staff to file amended financial disclosure forms noting that in 2001, I transferred title to the land to a Limited Liability Corporation," Reid said in a statement issued by his office.

Reid said he believed the 2001 sale did not alter his ownership of the land but that he agreed to file the amended reports because "I believe in ensuring all facts come to light."

Reid blamed the AP story as a "latest attempt" by Republicans to affect the election. AP reported last week that it learned of the land deal from a former Reid adviser who had concerns about the way the deal was reported to Congress.

Reid also announced he failed to disclose two other land transactions on his prior ethics reports and would account for those on his amended reports.

The title should have been this:
Harry Reid admits filing false ethics reports, avoiding rules of Congress.

So while he is making this unnecessary modification of a sale, where he thinks it was basically accurate anyway, he is going to change details of two other land transactions on his reporting forms.

Before transferring the land to the LLC, he had a 75% stake. Afterwards, he had a 75% stake. Solomon is being purposefully misleading by characterizing an LLC that Reid had a 75% stake in as being his friend's company.

Reid to Reimburse Campaign for Donations

Senate Democratic leader Harry Reid has been using campaign donations instead of his personal money to pay Christmas bonuses for the support staff at the Ritz-Carlton where he lives in an upscale condominium. Federal election law bars candidates from converting political donations for personal use.
Questioned about the campaign expenditures by The Associated Press, Reid's office said Monday he was personally reimbursing his campaign for $3,300 in donations he had directed to the staff holiday fund at his residence.

Reid also announced he was amending his ethics reports to Congress to more fully account for a Las Vegas land deal, highlighted in an AP story last week, that allowed him to collect $1.1 million in 2004 for property he hadn't personally owned in three years.

In that matter, the senator hadn't disclosed to Congress that he first sold land to a friend's limited liability company back in 2001 and took an ownership stake in the company. He collected the seven-figure payout when the company sold the land again in 2004 to others.

Reid portrayed the 2004 sale as a personal sale of land, making no mention of the company's ownership or its role in the sale.

Reid said his amended ethics reports would list the 2001 sale and the company, called Patrick Lane LLC. He said the amended reports would also divulge two other smaller land deals he had failed to report to Congress.

"I directed my staff to file amended financial disclosure forms noting that in 2001, I transferred title to the land to a Limited Liability Corporation," Reid said in a statement issued by his office.

He said he believed the 2001 sale did not alter his ownership of the land but that he agreed to file the amended reports because "I believe in ensuring all facts come to light."

Reid labeled the AP story as the "latest attempt" by Republicans to affect the election. AP reported last week that it learned of the land deal from a former Reid adviser who had concerns about the way the deal was reported to Congress.

On the Ritz-Carlton holiday donations, Reid gave $600 in 2002, then $1,200 in 2004 and $1,500 in 2005 from his re-election campaign to an entity listed as the REC Employee Holiday Fund. His campaign listed the expenses as campaign "salary" for two of the years and as a "contribution" one year.

Reid's office said the listing as salary was a "clerical error."

Residents and workers at the Ritz said the fund's full name is the Residents Executive Committee Holiday Fund and that it collects money each year from the condominium residents to help provide Christmas gifts, bonuses and a party for the support staff.

Federal election law permits campaigns to provide "gifts of nominal value" but prohibits candidates from using political donations for personal expenses, such as mortgage, rent or utilities for "any part of any personal residence."

The law specifically defines prohibited personal use expenses as any "obligation or expense of any person that would exist irrespective of the candidate's campaign or duties as a federal officeholder."

Land deeds show Reid and his wife, Landra, purchased a condominium for their Washington residence at the hotel for $750,000 in March 2001. The holiday fund has existed for years the at the condo, workers said.

Reid said Monday he believed the expenses were permissible but he nonetheless was reimbursing the campaign.

"These donations were made to thank the men and women who work in the building for the extra work they do as a result of my political activities, and for helping the security officers assigned to me because of my Senate position," Reid said.

Larry Noble, the Federal Election Commission's former chief enforcement lawyer, said Reid's explanation is aimed at a "gray area" in the law by suggesting the donations were tied to his official Senate and political work.

"What makes this harder for the senator is that this is his personal residence and this looks like an event that everybody else at the residence is taking out of their personal money as they're living there," Noble said.

On the land dealings, Reid announced Monday he had failed to disclose two other transactions on his prior ethics reports and would account for those on his amended reports along with the 2001 sale.

The first, he said, involved the sale in 2004 of about one-third acre of land in 2004 he owned in his hometown of Searchlight, Nev. And, he said he had not reported his ownership since 1985 of a quarter acre of land his brother gave him in 1985.

Reid said the failure to disclose those transactions previously was due to "clerical errors" and they amounted to "two minor matters that were inadvertently left off my original disclosure forms."

He had asked the Senate Ethics Committee last Wednesday for an opinion on the 2001 land sale but decided to amend his forms prior to the committee acting.

Reid's announcement came after numerous newspapers nationwide published editorials criticizing both his initial failure to disclose the full details of his Las Vegas land deal and his response to AP's story.

The $1.1 million land deal was engineered by Jay Brown, a longtime friend and former casino lawyer whose name surfaced in a major political bribery trial this summer and in other prior organized crime investigations. Brown has never been charged with wrongdoing, except for a 1981 federal securities complaint that was settled out of court.

Ethics experts told AP that Reid's inaccurate accounting of the deal to Congress appeared to violate Senate ethics rules and raised other issues concerning taxes and potential gifts.

Jesse Jackson Jr., Rep. Danny Davis or state Senate President Emil Jones, all of whom are black, in favor of either state Veterans Affairs Director Tammy Duckworth, who is Thai-American, or Attorney General Lisa Madigan, who is white.

“If Mr. Reid and others are offended by his presence, I’m left with no answers,” Riley said. “Sen. Burris is a former attorney general, former comptroller, he has impeccable credentials. Why wouldn’t a man of that character be an asset to the Senate?”

Reid spokesman Jim Manley acknowledged that his boss talked to Blagojevich but deflected a question about Riley’s suggestion that race was a factor in Reid's preferences.

Kleetn brings up an interesting argument though---one I have been thinking about for the past few days. Party affiliation aside, what's the proper course here? Personally I'd like to see all politicians in DC strung up by their self serving nads. So far Blago has not been removed from office but because he is accused of crimes does that mean none of his legislation or appointments are valid? Should a good piece of legislation or appointee have to fall by the wayside because of alleged wrongdoings by the gov? If he's removed from office or convicted of crimes should his prior executive moves be null and void?

This wouldn't be as big a story if Dems weren't always so fearful about looking insensitive to different races. It's PC-painted-into-a-corner-ness.
