offtopic: i worked in a collections office for verizon - crash

Interesting. They just sent me notice for an overdo bill from SEVEN YEARS AGO! They said it was the "final bill" at that location. I'm very particular about that sort of thing, and am certain I paid it - my guess is they credited it to the wrong account (maybe my new one?). The thing is I lived in a different town and don't even know what bank I used to pay it, and I'm sure that bank probably doesn't even exist anymore. So now I have to pay them - even though they just sent me an unrelated refund check for almost the same amount (with a dollar or so). Idiots! (no offense to you cb)

Seven years!?!? What is that crap?

on topic: I'm wondering, are OSHA rules invalid when a boss gives the okay?

if i cared enough and wanted to put the time in i'd research the guidelines...i have a feeling she's just interpreting them wrong...i'm sure it says something like the employee has the "right" to a lunch, not that they "have" to take it…I don't really care about the act itself that much, it just makes me wonder about her as a person

Seven years!?!? What is that crap?

statute of limitations is probably about to expire, and theyre making a last ditch effort to collect.

collections is such a disorganized business. it was when i was involved. could be one of a million things why it took them this long

youre guaranteed a lunch after 4 hours work, but theres no law says you have to take it after exactly 4 hours. some people take it after 4 and a half or 5, or whatever. just tell her youre taking lunch 3 hours late

I don't think it's OSHA, but Dept of Labor. She could be right, but her source is wrong. Google DOL.

And you also must have a fifteen minute break for every four hours you work Thrifty.

maybe in michigan, sass

in indiana, you are guaranteed 20 minutes for every 4 hours worked, altho its customary to give more than that. thats just the minimum requirement

LOL, my wife had a medical bill (fertility treatment) that she wanted to set up a payment plan...the hospital told her she couldn't set up a payment plan with them and they wouldn't take money unless it was for the exact amount...they told her to wait until it went to a collection agency and set one up with them

ok, now this tread has two topics going LOL

http://www.dol.gov/dol/topic/workhours/breaks.htm

Federal law does not require lunch or coffee breaks. However, when employers do offer short breaks (usually lasting about 5 to 20 minutes), federal law considers the breaks work-time that must be paid. Unauthorized extensions of authorized work breaks need not be counted as hours worked when the employer has expressly and unambiguously communicated to the employee that the authorized break may only last for a specific length of time, that any extension of the break is contrary to the employer's rules, and any extension of the break will be punished.

Bona fide meal periods (typically lasting at least 30 minutes), serve a different purpose than coffee or snack breaks and, thus, are not work time and are not compensable.

good link sarge...i'm having a tough time not showing her that...i have a problem, if someone's wrong i HAVE to correct them...not out of meanness or being pompous but i just hate disinformation...like i said though i don't really care so much about the issue itself...i just hope it's not a peak at what's to come

I understand how you feel wanting to correct her. My advise is to hold onto it in case you need it again. You can be like "Good news! I found the 'law' on this and we're allowed to forgo a lunch break, so you won't have your hands tied to force me to take a break!"

Well, it's either that or take your own suggestion, which is to tell her "Oh, by the way, you don't know what the hell you're doing, and here's all the proof you need." LOL!

Unless you're a smoker then it's 10 minutes every hour. LOL!

I love my boss! When I first started the job they didn't have enough new patients for me to have a case load so I sat in a hall way filing charts all day. All the supervisors and head hanchos would walk by and ask how I was doing in a real guilty way as if they felt bad for me. I would smile and say I was doing awesome and I loved the new job. I showed great attitude and a willingness to do whatever needed done. So not only do all the bosses know me by name but they all know I'm a team player and it has paid off big time for me. I get picked to go to special conferences and I get picked for cite surveys.

I am a true blue dyed in the wool company man.

Thrifty my former boss was that anal...she would say "according to labor laws for every 5 hours you work you have to take 15 minute break." so if I wanted to leave early I had to go sit in the break room for 15 minutes in order to 'keep the law'...was kinda like being in time out!

NO...it was like Thrifty said I wanted to leave early and work through lunch..but she would let you do that. So you had to take the 15 min..THEN take off early. Basiclly I would loose 15 min!

My current boss is even MORE ANAL (for Nigal) but the great thing is he knows it and freely admitts it! We laugh at each other...because we are so opposite!!!

Don't know about you guys but my boss is extremely cool. He realizes that I am on call around the clock so no complicated time sheets, no accounting for breaks.....just get the mission completed and we will worry about it later.

Course when little crap breaks loose on the weekend he knows I will be here.

great, i just asked someone that used to work for her what she was like and she said it gets worse...she wouldn't let her take short lunch breaks and if you knocked off early you had to take vacation time and she's a stickler, i mean within 5 minutes, of being on time

this really sucks...i'm salary for christ's sake...i haven't had a baby sitter since i was 8...if it was something relevant to my job i'd understand but this has nothing to do with it...as long as my job gets done and i put in the required time nothing else should matter...i usually work more than 40 hours/week

Thrifty I can SO feel for you. Years ago my first boss was a time clock watcher. We were field officers and had a set amount of Overtime already figured in our salary. Heck we had to work a 40 but like you said we rarely worked less than 60 or so.

After three years he decided to do a "billable time sheet".....in fifteen minute breakdowns.

So for a month our daily time sheet had the last half hour of the day printed "Filling out this ridiculous form".

On the lunch break - 15 minute break rule. I use to take two 15 minute breaks at lunch time (back to back) and then take my lunch hour the last hour of the day. That way I was legal, got a short lunch break and got to leave an hour early.
BS

that's a misconception though, at least for office jobs...employers only have to ALLOW the employees to take a lunch break...the employees are not REQUIRED to do so
