LOL - when I was in high school, a big-tittied brunette in my class got drunk at a party and danced topless on a table. Of course pics were taken, and everyone at school saw them. In contrast to the story, the cops weren't called, in fact the guidance counselor and the vice principal, and several other male teachers, looked at the pics and laughed along with it.

Of course this was back in the mid 80's

i just hope these kids dont get a "sexual deviant" tag on them for the rest of their lives. defineitely inappropriate, but the law doesnt need to get involved. whatever their parents and the school decide to do to them should be enough

Schools have been butting in more and more. I've heard of kids getting suspended for things they've done out of school when they were *supposed* to be on their parents' watch.

A parent found the pics and reported to police. The school was only superficially involved as I understand the story. The problem at this point is the distribution of underage nude pics over the cell phone may constitute distribution of child pornography under current law. That's the criminal aspect of this as I read it.

It appears no charges have been filed as of yet. It is the cell phone transmission that is the sticking point. If they had all gotten together in a room and stripped there would be no criminal offense. But the use of the cell phone is a legal problem.

The trickiest thing about the criminal distribution aspect of this may be the name the phone service is registered under. If it is in the kids name, they may be able to overlook it. If the service is in the parents name that may take it into a whole different level. In that case they might have to be able to prove who took and sent the pics. It could come back to haunt the parents. Worse yet, it could end up with Mom or Dad facing charges for distribution.

These kids had no idea the can of worms they were opening.

The issue at hand here is not so much kids being kids. It goes deeper than that and I can understand the mother's reporting to the police. The sending of underage nudity via cell phone is one of the most popular ways predators have of soliciting victims. Out of context, if Mom found pics of kids she did not know, and most of us don't know all our kids friends, I would expect that kind of reaction.

I agree, I don't think criminal charges should be filed in this case, but the can of worms is there and it has been opened.

The ages of these kids are the age that predators target most. They had no clue assuming the story is correctly reported. But it sure created a mess.

Not all that related, but kind of funny..
My wife's friend just broke up with her boyfriend because his family was too intrusive. Her ex's little brother is a senior and she was telling a story about how intrusive the mother is. The senior in high school brother had left his phone sitting out and got a text message. His mom opened up the phone and saw a message from a girl stating "I want to give you a bj." She said nothing to the boy but took the phone to the girl's house and showed her parents how the girl was corrupting her son.

With all due respect, this is not just “kid-stuff” or at least it should not be. Are any of you parents of kids in middle school/high school? If so, do you think it’s okay for 13/14 year old boys to be watching porn on their cell phones on the school bus every day? This happens in my school district and the kids are from upper-middle class families. Most parents have no idea what images are in the passworded parts of their kid’s cell phones. How would you like it if someone took a photo of your 13 year old daughter, granddaughter, niece, etc., without her knowledge, while she was topless (or worse) in a locker room, and then sent it to the phone of all of their friends?

A lot of the boys who are circulating these photos, and watching porn on the bus, have absolutely no respect for the girls and treat them accordingly. When my middle daughter was in 8th grade, it was very common for a boy to walk up to a girl, just a school friend, a girl who has never even had a date, and say “hey - want to blow me today?” Other times, the boys would simply touch them in a way that was uninvited and unwelcome. To those of you who have sons, is that the way you want your young men to act? Or is it okay for the boys, but not for the girls? If we, as parents, do not teach values to our kids, or let them know that this kind of behavior is not acceptable, then who will? Perhaps you think we should let them decide for themselves, or from what the see on TV or in the movies? After all, young teenager are known to be so good at making well -reasoned decisions.

It’s not only the boys - many of young girls have no respect for themselves either. Have you guys ever heard of “lipstick parties?” I guess it would be just fine for some of you, and consistent with your values, if you think this is just “kid-stuff”, for YOUR little girl to be one of 5 girls on her knees in front of 5 boys at a lipstick party. Just yesterday, at the high school where one of my kids is a freshman, there were pictures going around the boys’ cell phones of two 14 year old girls making out topless in a pool. Some of you probably think that’s pretty cool - I don’t - and the worst part is that the photos came from the girls. I know one of the girls involved, and I don’t her dad thinks it very cool. Those photos are now in cyberspace forever - probably to resurface years from now when she is getting married, or applying for a job. I guess it would be fine if YOUR daughter was in the picture - right? Perhaps those who think this is funny, or no big, deal, should “put their money where their mouth is” and post photos on TT of their daughters (or young women they care about) like the ones in the Fox News article. No big deal - just kid stuff - right?

We’re not talking about consenting adults here - we are talking about children who may be somewhat sexually aware but who have no appreciation for the consequences of their actions. By the way, naked photographs of minors is child pornography and illegal in all 50 states. It doesn’t matter who took the photos, or why, the problem is that kids are depicted in the images. As the result, in cases like this, it is often absolutely appropriate that parents, school administrators and, if necessary, the police get involved. Pedophiles and other sexual predators love those kind of photos that appear on My Space pages and/or Facebook.

I’m no prude and I do remember what it was like to be young, but this stuff is way over the top. It’s also a different and much more dangerous world for kids than when I was in high school. I don’t know whether criminal charges would be appropriate in this particular case, but in some case, they are appropriate. As a parent of three teenage girls, it’s my job to take a stand and I guess it’s pretty obvious where I stand. Maybe if what happened in the Fox News story were an isolated incident it would be no big deal, but I suspect most of you who “pooh-pooh” this either share the same values as the kids involved or just don’t know how big of a problem this is in schools. The 14 year old girls that are taking pictures of themselves and sending them around are the same girls who consider themselves “technical virgins” because they haven’t had intercourse but have had oral sex with 10-15 different guys before they get their driver’s license. Remember, if it’s okay for the girls in the Fox News article then it’s okay for your sons and daughters too. I expect better than that for my daughters, and I demand better than that from your sons.

in some states, yes, mooning does make you a sexual deviant. at least, thats what ive heard. im just saying i hope this doesnt happen to these kids. no way they should be smacked with a felony charge for a little naughty fun

crash... assuming the story is as reported.. maybe the best case would have been to talk with the kids first. But even then, there is a good chance it would have gone further than that. In the case of underage nudity there is a mandate for the law to get involved. Did the kids intend this. I don't think so. But I can tell you if I found nude oics of a kid I didn't know in my daughters possession I would want to know exactly how they got there. Take a few parents, put them together and some one is going to get the police involved if for no other reason that they are mandated reporters and are looking at jail time themselves if they don't report it.

Like I said, in today's world they could have had a strip party in a room all together and there would be no criminal leftovers. (Not that I think that's a good thing, but that's the way it is.) But when distribution is involved, it bumps things to a whole different level.

Please note, I am trying to leave the morality issues aside and deal just with the issues of law as I understand them. This _is_ serious stuff under the law. Like it or not... it pretty much had to go down this way. It is up to the law to decide whether or not to press charges and against whom.

The simple possession of child nudity can be a federal offense. I worked with a guy in Fed prison who was in the slammer for 1(one) pic of child nudity on his computer. This is murky water. And a real can of worms.

I have a 13 year old daughter, and and 18 year old son. I can tell you that the sense of moral "relativisim" is pervasive as ever.

This is not a condition that either side of the political spectrum has a monopoly on. IN fact the attitude that "I am only as guilty as my attorney/publicity agent/public opinion" says I am has been evident in my experience...throughout the spectrum.

I see it coming from our devaluation of TRUE guilt. We take past actions and punishment and try to equivocate present or future actions. We allow people to establish their own rules, then we allow those rules to change to fit the occasion.

Guilt, or the image of Guilt is now subjective, and emotional. The guy a few years ago in (I think) California who kidnapped the girl, raped her, cut off her arms and left her for dead was tried, then the media went bananas, NOT for the crime but the fact that he showed no "remorse". I think he flipped off the judge or jury.

It is this sick attachement to "emotion" that bothers me. Emotion, as I have said time and again, is not able to be quantified. How "sorry" do you have to be to be considered truly contrite? Can you truly say,"A the murder is more "sorry" than B the murderer? No, not and apply the coldly logical process of prosecution to the criminal.

Justice has always been "getting what you deserve". But I have seen, time and again, true vicious criminals learn how to use the system. Learn how to twist and turn to just "hedge" the line and barely avoid the full extent of their crimes.

Additionally I have seen the people who truly recognize they screwed up agree to take responsibility for their actions get Nailed to the wall. What message does that send?

NO kids today are told to grow up so fast, by the "freedoms" we allow them, but are given a pass on the "responsibility" that normally go with the freedoms. When I grew up in Texas, I started working construction at 14. At 16 I could go into the "construction bars" and drink, but....BUT I had to behave and accept the consequences.

Today we see 14 year old kids with .380 automatics robbing and beating pizza delivery men. Then when arrested Momma shows up with her A'tunny" and done demand we release him cause "he done have problems". (oh it was a white mother and S-bag son) my solution, Junior goes to YDC, then a foster home in NEBRASKA, Momma does 10 for armed robbery.

Not gonna happen...but its very frustrating.

Crash, didn't really mean the Moose thing and you know it. I only get political when it comes to "political" stuff. Personally neither party shows the political direction I want.

As you know I favor more local solutions, I truly believe that the American People can solve stuff easier and cheaper than any government drone ever could imagine.
