KnifeView Messages“Chili, as a collector of knives we learn of strange but relevant rules of the trade. One of which is that the person who is implementing the law at the time has control of the law then. I am just trying to offer some good safe advice. To the one who asked. I find it better to just follow the rules and avoid problems. All of the advice I have given is correct.” 11:41:12 AM 2/28/08 “Generally, tilt, concealment is a huge indicator of intent to go armed if the weapon is readily accessible. However, when it is in the backpack that must be taken off and then opened to access the knife, I wouldn't consider that "concealed". Granted I haven't pulled the case law on this issue, but it is much like transporting a weapon. It is not illegal to have a pistol in the glove compartment (where it is well concealed), provided it is unloaded and the ammo is in a position where it takes another overt act to access it. (such as the trunk). Similarly, having the pistol and the ammo in the trunk would not necessarily imply intent as long as there is some other "explaination" for it. (such as returning to the gun range). Thus, as is my position, I think the "crime" is a combination of intent and context. If I get busted for having the knife in my backpack, I might be wrong and have to pull some time with the thugs up at Brushy Mountain, but I can assure you it won't be without me putting up a good defense. last edited: 2/28/08 11:51:20 AM” 11:46:25 AM 2/28/08 “Chili, can I keep you on retainer? Not that I forsee any problems, but you seem like the type of lawyer I would want representing me.” 11:48:34 AM 2/28/08 “I'd never arrest a backbacker for carring a knife. There must be other crimes or intent to do harm before I'd even give it a second thought.” 11:54:40 AM 2/28/08 “Hmmm. As with many other issues, 'concealment' starts to look like "damned if you do ----- damned if you don't" LOL” 12:01:36 PM 2/28/08 “Why do you think this country is full of damn lawyers?” 3:38:07 PM 2/28/08 “LOL” 3:49:30 PM 2/28/08 “Don't bring anything double bladed into NYS - not even a letter opener. Trust me.” 10:17:01 AM 2/29/08 “anyone seen or have a leatherman skeletool? They are new, and supposedly the lightest of their full size multi's.” 11:50:19 AM 2/29/08 “I saw an ad for them and I want one. I carry a leatherman super tool and it's great, but damn is it heavy! Sometimes I carry a ahnd made antler handled hunting knifev with about a 5" blade instead. It's lighter than the leatherman, and I can eat off it. Just ask Nigal. He saw me eat ramen and oatmeal w it in RRG.” 11:59:16 AM 2/29/08 “...mmmmm, oatmeal, yummy....” 12:15:22 PM 2/29/08 “"ust curious what kind of knifes y'all carry when you BP." Only the one planted between my shoulder blades from a few choice peeps that post on this board.” 1:21:05 PM 3/02/08
