In 1956 President Eisenhower issued an executive order authorizing the military to shoot down or sink any foreign eavesdropping airplane or ship within 20 miles of the U.S. coastline. That would still be international waters. This policy was expanded in 1972 when the Navy sunk a Soviet intelligence gathering fishing trawler that wandered too close to fleet naval exercises in the mid Atlantic. the U.S. recovery of the sunken Soviet sub in the Pacific by the CIA was clearly a violation of international maritime law -- the U.S even admitted that. A common tactic used by both sides during the Cold War was to 'stray' close to the other side and electronically monitor the response. I cannot say whether our plane did this last week,but it certainly is possible and likely. Spying is a dirty but necessary business. A 200 mile economic interest zone is often claimed and generally respected. A nations air space is generally agreed to include the air above the territorial waters (i.e. the 12 miles or so byond the coast). Thus, outside those first twelve miles of ocean, the air above the the 200 mile economic zone is generally considered to be international air space. I'm not trying to make an argument for either side. Precedent has shown that both sides will lie in cases like this. The thing is that the Chineese plane colided with the spy plane. It did not shoot it down. A colision is not a deliberate attempt to down the plane. Since it was an accident, then the fault goes to the party that caused the accident. That would be the Chineese pilot for coliding with the spy plane. Also, when a US plane is damaged like that, the plane becomes Us territory and cannot be boarded. If it is, that is considered a breech of our boarders and an act of war. The fact is that this accident is not our fault. We had the right to be there. Apparently he was a real "hot dogger" who would fly close enough to hold up a sign with his email on it. Two conclusions: 1. This is all "routine" for the fly boys (remember Tom Cruise taking polaroids of the cockpit of the MIG in Top Gun (not that hollywod is reality, but flashing your emial address is pretty close), and 2. He hiked into Tibet (with permits) and soon took some pictures of the "People's Army" beating the heck out of Tibetan Monks who were peacefully protesting. His camera was taken away and he was jailed by the Chinese until various people intervened for him and he "apologized." When he returned he became very involved in the birth of a new "Free Tibet" movement. (This was in the mid 70's). If the nature of the game is as you describe it, then it looks like the Chinese performed brilliantly. Of course, it would now be up the the US to come up with some good counter moves and make sure China regrets it. As long is this is a game of chicken, the Chinese will win.
